Ab 2027 melden Börsen, Broker und Krypto-Apps dem Finanzamt jedes Jahr, wer bei ihnen Krypto kauft: Name, Steuernummer, Beträge.
Gesammelt wird schon lange.
Ganz ohne konkreten Verdacht.

Danke @bitcoin_at!
Wir bei @coinfinity unterstützen die Initiative. Warum, steht hier: coinfinity.co/blog/dac8-besc…

Growing up, I heard absurd stories about communist surveillance in Czechoslovakia.
I thought we'd never have to fight for basic privacy again. Yet here we are. DAC8.
Huge respect to @BULLBITCOIN_ and @bitcoin_at for taking a stand.
France. Austria. Guess who's next. 🇨🇿🇸🇰
DAC8 surveillance now challenged in France and Austria.
Respect from the Firefish team to @bitcoin_at and @BULLBITCOIN_.

🇦🇹 Bitcoin Austria Challenges DAC8 Cryptocurrency Reporting Rules
Bitcoin Austria has launched a legal challenge against DAC8, an EU Directive requiring cryptocurrency service providers to report customers’ names, addresses, tax identification numbers, and annual transaction totals to tax authorities.
The complaint argues that the rules require personal financial records to be collected without suspicion of wrongdoing, while exposing customers to physical security risks should those records be leaked.
In its accompanying campaign, Bitcoin Austria warns that names and home addresses linked to crypto activity could help criminals identify potential targets for robbery or extortion, known as wrench attacks.
This is the second challenge against DAC8, along with a legal challenge launched in France by Bull Bitcoin beginning of this year.

Rules for crypto are a security risk and infringe on our privacy.
How much cash you withdraw from an ATM is not being tracked, how much you send from an exchange to your own wallet will be.
This regulation creates a list of names and addresses that puts people at risk.

Solche Daten geraten oft in falsche Hände.

THE FIGHT AGAINST DAC8 BEGAN IN FRANCE.
IT IS NOW SPREADING ACROSS EUROPE.
Bull Bitcoin opened the first front in France, where it is challenging the decree that transposes DAC8 into French law before the Conseil d’État, the country’s highest administrative court, and asking for the directive itself to be referred to the EU Court of Justice.
@bitcoin_at has now opened the second front in Austria: at its initiative, attorney Dr. Oliver Völkel (CERHA HEMPEL) has filed a complaint with the Austrian Data Protection Authority.
The case is set to go through the Federal Administrative Court to the Constitutional Court, and from there potentially to the EU Court of Justice, the same road that brought down EU data retention in 2014.
As a non-profit association backed by local industry actors, Bitcoin Austria puts its time, effort, and reputation on the line for every Bitcoin (and crypto) user in Europe. This work deserves the respect of the entire industry.
Because DAC8 has been transposed in all 27 Member States, it can be challenged in every one of them, and with two fronts now open, 25 remain.
We invite associations, lawyers and industry players to bring this fight to their own country and to join the European front. More information below 👇

Financial surveillance protects no one. It hands robbers the addresses.
Since January, every crypto provider in the EU has to record who buys bitcoin, sells it or moves it to their own wallet. From 2027 the data goes to the tax office every year, and it is kept for ten years. The EU calls this DAC8.
France shows where such data ends up. In January, thieves took the gains and holdings of customers of the crypto tax service Waltio, and investigators believe gangs used the list to pick victims for home invasions. In February, an attacker posing as an official pulled the records of 1.2 million accounts from the national bank account register. A tax officer near Paris is on trial for allegedly selling data from the tax system to organized crime, including data on crypto investors. French prosecutors count well over a hundred crypto kidnappings and attempts since 2023.
Austrian criminal law has a precise standard for this. Intent already covers anyone who seriously considers a crime possible and accepts it (§ 5 StGB). Anyone who contributes to another person’s crime counts as a perpetrator too (§ 12 StGB). Lawmakers know about the leaks and the kidnappings, and they keep the collection running. A private citizen who listed his neighbors’ names, addresses and wealth, knowing that such lists end up with robbers, would be an accomplice. The state obliges every provider to keep exactly such lists.
Against crime, the surveillance barely works. The money laundering researcher Ronald Pol estimates that the entire anti-money-laundering regime touches less than 0.1 percent of criminal proceeds and costs more than a hundred times what it recovers. What it protects is the tax collector’s reach into everyone who owns something. The robbers take what the list shows them, and the state takes the rest.
Two challenges are under way. In Austria, @bitcoin_at has filed a complaint, backed by @coinfinity, to bring DAC8 before the Constitutional Court. In France, @BullBitcoin_ asked the Conseil d’État in February to annul the French decree, which goes even further than the directive. Both refuse to treat a hit list as a routine compliance task, which is rarer in this industry than it should be.
Austria’s Constitutional Court struck down data retention in 2014. I hope DAC8 meets the same end before the first Austrian list appears on the darknet.
