In the recent case of Silva Estate (Re), [2026] ABCA 325, the Court of Appeal of Alberta upheld a decision by the Court of King’s Bench of Alberta that removed a daughter (the appellant) and her husband as personal representatives (PRs) from her mother's (the deceased) estate. The Court of Appeal also ordered the appellant to repay funds that were unaccounted for back to the estate. However, it allowed the appeal in part, overturning a ruling that would have seen CAD 518,595 deducted from the appellant’s inheritance. 💡Learn more in our News Digest update: bit.ly/4sOtQJR #STEPCPD #Canada

How can a trust provide trustees with greater clarity when beneficiaries want their values reflected in investment decisions? We have added new draft US investment provisions for inter vivos trusts have to STEP’s Responsible Stewardship Toolkit. The clauses are intended to give trustees express authority to consider responsible investment approaches aligned with beneficiaries’ interests, including the potential non-financial benefits of investing in accordance with particular environmental, social or governance factors, standards or themes. They also provide guidance around trustees’ responsibilities and protections when taking these considerations into account. 👉Read the new provisions: step.org/responsible-steward… #STEPProfile #RSOW

Legislation announced in the UK government’s budget on 28 October will allow a personal representative to direct pension scheme administrators to pay inheritance tax due on a pension fund directly to HMRC. The new policy has been introduced after professional organisations, including STEP, pointed out the practical difficulties for personal representatives arising after April 2027, when most unused pension funds and pension death benefits will be included in an individual's estate at death, regardless of whether they are written in trust. 📖Read more in our Industry News update: bit.ly/4swiXfG #STEPCPD #IHT
