Don’t look now, but the bipartisan 340B Rebate Model Delay Act has 17 co-sponsors since being introduced last month.
As always, we are thankful for the program’s supporters.

Maine Hospital Association President Jeff Austin has said hospitals in the state average less than two weeks of cash on hand, underscoring how quickly additional working-capital demands could become a liquidity concern with 340B rebates.

💥House lawmakers have introduced another bipartisan bill aimed at stopping 340B rebates.
🎯The PROTECT 340B Act would also establish a neutral claims clearinghouse to prevent duplicate discounts, and it would bar discrimination against 340B entities by PBMs and insurers.

Missouri Attorney General Catherine Hanaway has ordered Eli Lilly to stop requiring 340B entities to submit claims data from in-house pharmacies within 30 days or face legal action.
“Big Pharma does not get to bully Missouri hospitals or hold prescription drug prices hostage,” she said. “Eli Lilly is abusing its market power to impose higher prescription prices in Missouri. These tactics fall hardest on rural communities that depend on the 340B program to keep clinics open and ensure patients receive the care they need.”

“The 340B drug discount program is not an entitlement program, and it is not a state budget line item,” writes Texas entrepreneur Joacim Hernandez. “It is a federally established, voluntary, and market-based mechanism that uses manufacturer discounts to help local health care providers serve their communities.”

Community health centers shouldn’t have to float loans to drug manufacturers.
340B drug discounts fund critical care like insulin and substance use treatment for patients.
A looming policy switch to a "rebate model" will force health centers and other safety-net clinics to pay full price for meds while waiting for a rebate that may or may not come. This shift to a rebate model threatens affordable healthcare in rural and underserved areas across the U.S.
🗓️ TOMORROW (Oct 27) is the 340B Day of Action!

ICYMI: With Big Pharma, the Trump administration failed to heed the lesson of the parable the president is so fond of reciting at rallies. Link to post in comments.
Hospitals told CMS they would lose between $7 million and $109 million a year under its proposed Medicare Part B 340B payment cuts for 2027. At risk are Rx assistance programs, infusion centers, oncology services, inpatient psychiatric services and more.
Next year could be a very stormy ride for safety net providers and the patients they serve.
💪A full federal appeals court will hear oral arguments Oct. 27 on 340B contract pharmacy access laws in Maryland and West Virginia after a divided 3-judge panel ruled them unconstitutional.
💪💪Otherwise, every court has ruled in favor of the states.

Good news! A federal judge rejected PhRMA’s request to block enforcement of Vermont’s 340B law, which bars manufacturers from requiring claims data from contract retail or in-house pharmacies.
Another in a lopsided series of rulings favoring states over Big Pharma!

President Trump often cites a poem about a woman who rescues a dying snake and nurses it back to health, only to suffer a poisonous bite. The parable applies to the administration’s treatment of Big Pharma.

Recent study finds the median list price for all drugs from 2008-2025 was $127,502 — and a whopping $254,213 from 2020-2025, showing the steep inflation in recent years.
These prices are unsustainable for patients and the healthcare system, yet that’s what Big Pharma is fighting so hard to protect.

BREAKING NEWS: The American Hospital Association, Maine Hospital Association and four health systems today filed a federal lawsuit to stop the government’s 340B rebate pilot program.
The plaintiffs argue that HHS once again failed to account for the cost of the program, which 340B hospitals said could cost more than $1 billion annually, and ignored their proposed alternative for ensuring program integrity.
“For the sake of our shared goal of protecting patients and expanding access to care, those costs, consequences and alternatives cannot be treated as afterthoughts,” AHA President and CEO Steve Walsh said.

ALT A large, angular concrete building is shown, known as the Hubert H. Humphrey Building, located in Washington, D.C. The structure features a modernist architectural design with multiple rows of rectangular windows. The surrounding area includes trees, a few pedestrians, and parked vehicles. The sky is partly cloudy.
Poll finds widespread concern over costs of pharmaceutical drugs, plus “broad, bipartisan agreement that there should be more government regulation when it comes to prescription drug costs.”
