Miami Beach sent armed police to Raquel Pacheco’s home because she criticized the Mayor’s rhetoric about Palestinians on social media. The officers refused to leave and told her not to post such content again.
Now, a federal judge has ruled that Raquel’s First Amendment lawsuit, brought by ADC, can proceed.
VICTORY in @adc case Pacheco v. City of Miami Beach! Earlier this year, the Mayor sent police to veteran Raquel Pacheco's house because she had criticized the Mayor's dehumanizing rhetoric against Palestinians on social media.
The cops refused to leave even though she said she didn't want to speak to them without a lawyer, insinuated her post could be unlawful as it could incite violence, and told her to refrain from posting such content in the future.
Today, the judge in the Southern District of Miami DENIED much of Defendants' motion to dismiss, finding that the police visit could constitute unlawful viewpoint discrimination and retaliation under the First Amendment. The judge also held we could proceed on our theory of municipal liability against the City, because we had alleged facts demonstrating a pattern or practice of discriminating against pro-Palestine speech in the City of Miami Beach. “The more I studied Zionism, the more I spent time there, the more I realized that every inch of Israel is Palestine. It was always Palestine.
Jews were never not allowed to live there as equal citizens, as they are in Britain or any other Western country. But the establishment of this state really did mean this massive ethnic cleansing that was not just a one-off.”

The United States was founded on the principle of religious freedom for all Americans, regardless of their faith or background. Article VI of the Constitution is unequivocal: there is no religious test for public office. Imposing sectarian litmus tests to disqualify candidates based on their faith is a direct assault on the pluralistic values and constitutional guardrails that define our democratic republic.
Senator Moreno's remarks were not only bigoted against American Muslims, but also Jews, Sikhs, Buddhists, and everyone else who does not share his understanding of Christianity. Every Senator should renounce his anti-Muslim, anti-Semitic and un-American remarks.

NEW: Netanyahu or not, we must not let Israel’s elections become an excuse for U.S. lawmakers to go back to “business as usual” with the Israeli government while it continues a genocide, warns IPS scholar @PhyllisBennis on @AJEnglish.
Do non-citizens have First Amendment rights? Can the government constitutionally jail people for criticizing Israel?
ADC President and Legal Director @JeninYounesEsq joined No Prerequisites to discuss the Trump administration’s crackdown on speech critical of Israel, the constitutional questions it raises, and the chilling effect on free expression.

The government really doesn’t want us to know what they’re doing with our phones. They just alerted me they are intending to respond to the judge’s order to show cause, meaning they are doubling down on maintaining the redactions
Once again, @matthew_petti of @reason does a fantastic job covering our case. As he noted, Judge Brinkema’s order to the government to provide unredacted declarations establishing what was done with our clients’ phones and laptops and what data was taken off them is significant. “The Court finds that most of the redacted information is not privileged law enforcement information and should not be sealed,” she declared. We are finally getting a look behind the government's covert efforts to access the contents of Americans' phones by seizing them at the border, without a warrant or even individualized suspcison.
In @adc's latest phone seizure case, Imam v. Mullin, the court in the Eastern District of Virginia ordered the gov't to provide information about precisely what it did with our clients' phones and laptops from declarants with firsthand knowledge. The government submitted declarations that appeared to redact the relevant information, including the basis for the seizures, as well as what was done with Plaintiff Imam's devices.
Judge Brinkema just found these redactions unwarranted and ordered the government to unseal most of them.
In a new piece, Reason writes that ADC is “stacking up victories” in its legal battles over CBP’s seizure of Americans’ phones and electronic devices.

Portrait of a people "resistant to Palestinian pain but traumatized from war, fed up with the world"
In my interviews with Israelis, a portrait has emerged: a people defiant but weary, resistant to Palestinian pain but traumatized from war, fed up with the world but fearful of global isolation, and in a tug-of-war with themselves.

Morning Joe gets emotional over RFK Jr.'s racist anti-Arab remarks
Bobby Kennedy was the reason I got involved in politics and I told Jr. that. He understood that we were stronger as were more diverse.
It's hard to even imagine how ashamed he would be of his son for denigrating over a billion people because of their faith.
Specifically when Bobby Kennedy talked about how America had to move to becoming a country that moved beyond prejudices based on faith and race.
This is what RFK Jr. did when he campaigned with Mike Rogers, another guy that I've known, liked, respected—who's running an abhorrent, racist, bigoted campaign.

“It was like this biblical battle where the Palestinian men … went in front of me to protect me.”
It’s young Palestinian men who put their lives on the line every day to defend their families, homes, and even foreign journalists from violent Israeli settlers and soldiers.
“It was like this biblical battle where the Palestinian men … went in front of me to protect … me and my rescuers from being attacked again,” Washington Post photojournalist Heidi Levine told Jake Tapper.
Levine was kicked, beaten with clubs and robbed by Israeli settlers while covering Friday’s olive harvest in the occupied West Bank, leaving her with multiple broken bones. Speaking after leaving the hospital, she said Israeli soldiers charged Palestinian farmers as settlers advanced alongside them. She said that unlike her, Palestinian victims endure these attacks daily, with absolutely nowhere safe to go.

Once again, President Trump resorts to fearmongering and hateful rhetoric instead of offering real solutions to the problems Americans face. Families are struggling with the rising costs of groceries, gas, and basic living expenses, yet the President would rather stoke fear and division than address their concerns. This rhetoric is tired, dangerous, and designed to distract from the realities facing everyday Americans. I hope voters see through these tactics so we can come together and focus on getting this country back on track.
