🧵1/3 Accountability Watch Afghanistan (AWA) expresses serious concerns about the implications of the International Criminal Court (ICC)’s decision to separate the Afghanistan investigation by assigning a second 'situation', Afghanistan II. We join civil society organizations to question the Court's decision, and demand its full explanations. On 20 October 2026, the ICC Presidency assigned the 'Situation in the Islamic Republic of Afghanistan II' to Pre-Trial Chamber II. Previously, on 15 July 2026, Pre-Trial Chamber II directed the Office of the Prosecutor (OTP) to open a separate investigation based on the six-state referral of November 2024, provided the requirements of Article 53(1) remained satisfied. The OTP sought clarification and reconsideration. The Chamber rejected those requests and reaffirmed its direction on 3 September 2026. Consequently, a majority of the Presidency assigned the second situation, Afghanistan II, to the same Chamber.

2/3⚡ We question why a separate investigation is necessary when the OTP has already investigated the alleged conduct and the Chamber has issued arrest warrants within the existing Afghanistan situation. Moreover, it is also unclear what the the status of the existing cases and open investigations and inquiries will be following the new 'situation'.

3/3⚡ Among others, the Pre-Trial Chamber’s decision carries potentially significant consequences to whether victims’ harm from serious crimes beyond gender persecution will still fall within the scope of the Court’s open investigations, or whether their access to potential justice and accountability will be reduced and stripped by this decision. In June 2026, Accountability Watch Afghanistan (AWA) developed an advanced documentation portal available in English, Farsi-Dari, Pashto and Uzbek languages. The portal was established in response to the intensified and systematic violations of human rights in Afghanistan, the restrictions on civic space, and the challenges to access information. ⤵️

Accountability Watch Afghanistan welcomes the @IntlCrimCourt’s arrest warrants against Taliban officials: Haibatullah Akhundzada, Abdul Hakim Haqqani, Habibullah Agha and Neda Mohammad Nadim. This marks a significant development in efforts to establish individual criminal responsibility for the Taliban’s systematic persecution of women and girls and those perceived to oppose or resist its policies. #States must take all necessary measures to facilitate their arrest and surrender to the Court. AWA urges the international community to ensure that these warrants do not remain decisions on paper. States must fully cooperate with the ICC and must not allow Taliban to escape justice and accountability through diplomatic engagement, travel exemptions or political considerations.

We extend our gratitude to @EU_UNGeneva as penholder of Afghanistan’s resolution at #HRC63, for their role and leadership in preparing and passing a comprehensive resolution on Afghanistan. Thank you for supporting Afghanistan’s civil society and for echoing women’s and minorities’ voices in the @UN_HRC debates and discussions on Afghanistan. #Afghanistan #Accountability
Today #HRC63 unanimously adopted a resolution led by the EU, on the situation in 🇦🇫. The resolution, adopted with wide cross-regional support, renews the mandate of the Special Rapporteur & ensures continued close attention to the abysmal human rights situation on the ground.

Afghanistan: Amnesty International welcomes the adoption of the latest resolution on Afghanistan at #hrc63 by @UN_HRC. Amnesty International looks forward to the much-needed study mandated by the resolution on national or ethnic, religious, and linguistic minorities, as well as to the Council's decision to continue focused discussions on the rights and circumstances of women and girls in the context of the Taliban's ongoing systematic and widespread human rights violations and abuses. The Taliban must be held to account and compelled to end their abusive rules, practices, and policies.

We welcome the United Nations Human Rights Council's resolution A/HRC/63/L.8 on the situation of human rights Afghanistan. The resolution mandated the UN Special Rapporteur @SR_Afghanistan to conduct a study on the situation of persons belonging to national or ethnic, religious and linguistic minorities in Afghanistan, and to present that report, in combination with an oral update, to the 82th session of the General Assembly. Ahead of the resolution, Accountability Watch Afghanistan submitted inputs independently and advocated as part of civil society call urging the HRC to mandate the SR to conduct a thematic report on the situation of minorities in Afghanistan alongside his continued reporting on the situation of women and girls.

The #Resolution adopted today strongly echoes the recommendations of the civil society and it includes the #following: 1. Welcomes the update by the Office of the High Commissioner on the advancement of the operationalization of the independent investigative mechanism and the deployment of the start-up team; 2. Requests the Secretary-General to appoint the staff of the mechanism as expeditiously as possible, taking into account the experience of other relevant mechanisms, and to recruit or allocate impartial and experienced staff with relevant skills and expertise, drawing upon the terms of reference prepared by the United Nations High Commissioner for Human Rights; 3. The UNSR to present a report to the Human Rights Council at its sixty-sixth session, together with a study on the human rights situation of persons belonging to national or ethnic, religious and linguistic minorities in Afghanistan, and to present that report, in combination with an oral update, to the General Assembly; 4. The UNSR to present to the Human Rights Council at its sixty-fifth session an oral update on the situation of women and girls in Afghanistan, adopting an intersectional approach, to be followed by an enhanced interactive dialogue;

The OHCHR to present, jointly with the IIMA annual reporting, at the HRC 64 session, a report focusing on the impact of the Taliban’s dismantling & replacement of the legal & judicial framework of Afghanistan, with particular attention to access to justice & effective remedies, including an assessment of the impact of changes to the legal, judicial & institutional framework on the enjoyment of human rights. Pakistan has failed to exercise due diligence in conducting cross-border strikes against the TTP hideouts in Afghanistan, even if the Taliban are responsible for the group's presence. This has led to harm to civilians and civilian properties. Accountability Watch Afghanistan calls for the protection of civilians in the ongoing tension between the Taliban and Pakistan. The Taliban's responsibility to prevent anti-Pakistan militants operating from Afghanistan's territory does not exempt Pakistan from its international law obligations in the conduct of military operations. #Protection #Civilians #Afghanistan
