JUST IN: 🇺🇸 The SEC keeps moving on crypto without Congress, adding 3 new answers on who controls a crypto network.
Under the new guidance:
1. Token holders voting on a network generally don’t count as a “central party,” unless they’re affiliated or agree to act together.
2. A central party “oversees participation” if it can control access at the protocol, validator or user level.
3. A network being “functional” (its token actually works on it) is different from being “decentralized” (no one controls it).
It’s the SEC’s latest crypto move since the CLARITY Act failed a Senate vote 49 to 50 on Sept 15:
- Sept 17: an exemption for trading tokenized US stocks on blockchain venues
- Sept 25: a crypto FAQ on how securities laws apply to tokens
- Oct 1: a proposal on how investment advisers and funds can hold crypto
It's OVER.
The SEC and CFTC are done waiting for the CLARITY Act.
Regulators have now made at least 9 moves to build crypto rules without Congress.
1. SEC Crypto Task Force
- define what is and is not a security
2. Project Crypto
- modernize SEC rules for onchain markets
3. SEC-CFTC crypto guidance
- classify crypto assets into clearer categories
4. SEC-CFTC harmonization MOU
- reduce overlap between the two agencies
5. Joint Harmonization Initiative
- create shared rules for crypto firms
6. CFTC Innovation Task Force
-speed up crypto and blockchain market rules.
7. CFTC crypto FAQs
- clarify how registered firms can use blockchain
8. SEC Innovation Exemption
- allow tokenized US stocks to trade onchain
9. CFTC proposed crypto market rule
- create a formal framework for crypto asset markets
Crypto may now move forward without CLARITY Act.

🚨 UPDATE: Binance hacker begins mixing of stolen funds, moving 28 BTC through CoinJoin, per Elliptic.
Funds have passed through roughly 12,000 wallets across 11 chains in over 40,000 transactions.
Around $3.24 BILLION still remains in theft-linked addresses, mostly ETH and BTC, while $2.85 BILLION has been frozen.
The hacker also sent $4 million to three Binance deposit addresses, potentially linked to third-party services.
Binance is restoring withdrawals in phases, with further networks planned for Tuesday.
🚨UPDATE: Binance processes $6.145 BILLION in net outflows as withdrawal pressure eases.
According to DefiLlama’s 24-hour snapshot:
- Net outflows exceeded the tracked assets of Gate, Bitget, Gemini, Bitstamp or MEXC individually.
- Binance still holds $128.87 BILLION in tracked assets, nearly 4.4x OKX’s total.
- The outflows equal approximately 3.6% of Binance’s previously reported $171 BILLION in AUM.
Binance’s scale stands out as it accommodates heavy withdrawal demand in the past 24hours.

Bitcoin and ETH both bounced today after the recent drop.
Bitcoin is back above $78,000 but needs to break the Daily MA 50 near $82,000 for this move to continue. Next resistance is $85,000 and $87,500. Support is $75,800, then the Daily MA 200 at $73,200.
ETH bounced off its Daily MA 200 and is holding above $2,300. Resistance is $2,550 and support is $2,168.
Both charts are in the same spot. Rejected at the highs and still under pressure until Bitcoin reclaims that MA 50.
Oil dropped below $100, which takes some pressure off risk assets.

INSIGHT: Bitcoin’s last THREE cycle bottoms came shortly after the U.S. midterm elections.
2014 → 71 days later
2018 → 39 days later
2022 → 13 days later
The next U.S. midterm election is TOMORROW, November 3rd.
If the pattern repeats, late 2026 to early 2027 could be a window to watch for $BTC’s next cycle bottom.
Three examples make an interesting pattern, but they don’t prove elections drive the cycle.
Binance began restoring withdrawals in phases at 06:00 UTC on November 1, 2026. By 12:36 UTC, withdrawals had resumed for all 15 networks and assets in the initial phase. After an initial spike, withdrawal volumes have declined and are stabilising as expected, while deposit volumes have remained substantial.
Between 06:00 and 15:30 UTC on November 1, we processed $4.649 billion in withdrawals and $1.01 billion in deposits, resulting in a net outflow of approximately $3.64 billion. This represents 2.1% of our $171 billion in total assets under management (AUM), based on the latest available Proof of Reserves (PoR) data as of October 28, 2026. A new PoR snapshot was taken at 00:00 UTC on October 31, and zero-knowledge proof (ZKP) computation began. The updated report is expected to be available on our PoR website tomorrow.
Our team continues testing rigorously the remaining networks and assets. We know how important safe and reliable access to your funds is and will share details of the next phase as soon as we can. Rest assured that market conditions are stable.
Thank you for your patience and continued support.
