The Crown Transferred Its Financial Obligations to Indigenous onto Generations of Canadians - Time to End This Unfair Wealth Transfer What many Canadians have never been shown clearly is who actually bears the legal obligation—and who merely pays for the government that administers it. Before Confederation, treaties and commitments were made in the name of the Crown. Confederation did not turn individual Canadians into parties to those agreements. The Crown continued as the constitutional institution, while the Canadian government assumed responsibility for exercising Crown authority and administering Crown obligations in Canada. That distinction is fundamental: The Crown is the continuing legal institution. The Canadian government exercises and administers Crown authority. The Canadian state is responsible for fulfilling obligations it has lawfully inherited. The taxpayer finances the state. The taxpayer is not thereby the original legal debtor or treaty party. A Canadian born generations later did not sign the treaty, make the promise, or personally assume the Crown’s obligation. Paying taxes to a government that fulfills a legal obligation does not make the taxpayer a party to the original agreement. The problem is therefore the transfer of financial burden, not the creation of personal treaty liability. The Crown’s obligations may be legally binding on the state—but they should not be transformed into an unlimited, perpetual burden passed from one generation of Canadian taxpayers to the next. The legal obligation must be identified, fulfilled and brought to finality.
