BREAKING NEWS ๐Ÿšจ Home Affairs To Accept Asylum Applications From People Who Entered South Africa Illegally The Department of Home Affairs will no longer turn away people seeking asylum simply because they entered South Africa illegally or do not have the required immigration documents. Deputy Director-General Thulani Mavuso told 702โ€™s Clement Manyathela today, Monday that refugee reception offices must accept applications from anyone who presents themselves and asks to apply for asylum. The move follows a Constitutional Court judgment delivered in July, which declared several provisions of the Refugees Act unconstitutional. The court found that procedural immigration violations could not be used to prevent asylum seekers from having their claims assessed on their merits. A department instruction issued on 28 September reportedly directs reception offices to accept applications from unlawful entrants, late applicants and people without asylum transit visas. Mavuso warned that the change could put further pressure on the department, with people already in South Africa unlawfully potentially joining queues to seek asylum. The Constitutional Court ruling was based partly on the principle of non-refoulement, which prevents South Africa from returning people to places where they could face persecution or serious harm. Home Affairs said after the judgment that it would comply with the court's decision while maintaining a lawful and well-managed immigration system.

I just interviewed the DDG at home affairs on #TheCMShow about the much talked about Asylum applications at refugee reception centres. He confirmed that the department will NO LONGER turn someone away at the door simply because they entered the country illegally. He admits that this is going to overwhelm the department because some illegal immigrants may take advantage and go queue and claim to be asylum seekers. This will cause an administration burden.

You can enter South Africa illegally, bypass a port of entry, have no visa, fail to report within five days and only later declare that you want asylum and Home Affairs must still accept your application without first requiring you to explain your illegal entry. Following the 7 July 2026 Constitutional Court ruling in Scalabrini [2026] ZACC 30 that invalidated key Refugees Act sections and regulations, all Refugee Reception Offices must immediately accept every new asylum application from anyone reporting in person. This covers unlawful entrants, late reporters and those without visas. Offices may not demand good-cause interviews, transit visas, refuse on entry grounds, impose quotas or require prior immigration processes. Prior turnaways must be assisted; appointments issued if capacity is limited. Applies only to receiving applications.
