"'I wasn't even in Pensacola.' That's what Jacob Rockwell told the Pensacola City Council after receiving a red-light camera ticket for a violation he says he couldn't have committed. His concern goes beyond one citation. Jacob argued that these cameras turn a fundamental principle of our justice system upside down. Instead of the government proving you committed the violation, the burden shifts to you to prove you didn't. He questioned whether that is consistent with due process and constitutional protections. His comments come as a Florida judge recently ruled the state's red-light camera law unconstitutional, finding that it improperly shifts the burden of proof to the vehicle owner. While that decision is expected to be appealed, it has renewed the debate over automated enforcement. If I am honored to be elected your next Mayor, I will review and cancel contracts that do not serve the best interests of the public, including Pensacola's red-light camera program.
