William Kilroy: The defense witness who became a prosecution asset. After reading William Kilroy’s testimony in the Matthew Farwell trial, I was struck by how spectacularly the defense’s decision to call Sandra Birchmore’s former boyfriend may have backfired. The defense sought to establish a history of suicidal statements. Instead, on cross-examination, Kilroy agreed with the prosecutor that Sandra as a “fighter” and “resilient.” He testified that, “She was lovely." "Even after losing her mom and grandmother she still made people laugh.” In essence, he sent the jury a message that Sandra was a young woman capable of humor during times of profound grief. Most significantly, Kilroy acknowledged that while Sandra had discussed suicide, she had never attempted suicide during the time he knew her and that he was never truly concerned she would harm herself. The prosecution also established that the statements occurred four to five years before her death. In a particularly touching moment, Kilroy identified his own handwriting on Sandra’s list, where he had written “I’m wonderful” and “I’m amazing” to encourage her. Rather than reinforcing the defense’s suicide theory, his testimony humanized Sandra and highlighted her resilience. No other witness has really done that. In a colossal trial advocacy miscalculation, the defense called Kilroy to establish one favorable fact on direct examination, only to have cross-examination turn that same witness into a powerful asset for the prosecution. Sometimes the most damaging testimony comes from your own witness.

NEW, LINDSAY CLANCY: In another filing, her defense is pushing back on how Judge Sullivan handled two “critical” jury notes before the September mistrial. On Sept. 3, the foreperson reported that a juror acknowledged doubt but allegedly refused to apply it “as the law states.” A second note on Sept. 4 again brought up concerns about the juror’s “application of reasonable doubt.” Clancy’s attorneys argue the judge should have investigated whether the holdout juror was refusing to follow the law, rather than simply disagreeing with the other jurors. Prosecutors maintain the notes did not establish misconduct and that more questioning risked intruding on deliberations. In another Oct. 28 filing, Clancy’s defense agreed to redact a juror number from the public record, but accused prosecutors of using the request to advance a separate motion looking to restrict statements to the media. The defense wants the murder charges on double-jeopardy grounds, arguing the mistrial could have been avoided. See you in Plymouth Monday for oral arguments…

Poor Sandra! I had no idea her mom was on life support & Sandra had to decide to let her go😢
Replying to @GrantSmithEllis
"You dated Sandra after the loss of her mom and grandmother and this was a difficult time?" "Yes, her mother died in June of 2016 and her grandmother soon after." "You knew her father wasn't in her life, she had limited means and few family members?" "Yes." "You knew her mom had health issues for a while?" "Yes." "And you knew Sandra, at 18, made the decision to take her mother off life support?" "Yes." "And her grandmother, you said they were two peas in a pod, she lived but then passed away a month later?" "Yes." "And this was hard on Sandra, she had depressed moments and talked of taking her life?" "Yes." "And this was after she lost two people close to her, and at that point she was 19 or 20?" "Yes." "And she never attempted to take her life during that time?" "Yes."

Dear X, There have been several stories about @DoctorTurtleboy otherwise known as Aidan Kearney. Some good. Some bad. THIS IS THE ONE TO WATCH! Mel has done the research, and taken the time to put together a fantastic educational piece. @melandrebecca have put all the info together for a piece that is shocking and revealing; and tells the story without needing drama to move along. Think you know the Turtleboy story? Watch this piece and you truly will. xoxo, Ben youtube.com/live/ypiOC_grMC4…

The Defense is making a Motion for Aquittal stating the Govt didn't prove that Sandra was going to report Farwell's crime of statutory rape. The judge isnt having it, citing Dr Smock's testimony & that the relationship with Farwell was changing as Sandra became 1/2
Defense attorneys are arguing against the federal charge that Matthew Farwell killed Sandra Birchmore and her baby to silence a witness. They plan to file a motion for acquittal. The government has argued Sandra was going to report his crime of statutory rape. Defense attorneys say they haven't proved that. Julia Perlin, who called the Stoughton PD about her friend Sandra's relationship to Farwell, didn't testify. Prosecutors are now describing the evidence outside the presence of a struggle and injuries Sandra suffered before she was "strung up on that ligature." Prosecutors laying out consciousness of guilt, "he wiped his cell phone," per Billy Farwell, and lied to state police.

2/2 more "incessant" with Farwell about what she wanted. Defense wants to present evidence of Sandra's consensual choking behavior," based on Dr. Smock' "cos testimony about ligature marks. They will file a motion.

The written Motion for Aquittal 👇
Matthew Farwell’s legal team spent the night putting together a Rule 29 Motion for Judgment of Acquittal right as the prosecution officially rested its case. The move looks desperate, especially considering what went down right before it was submitted. Chief U.S. District Judge Denise Casper has completely dismantled the defense’s core arguments from the bench, dealing a massive blow to their narrative outside the presence of the jury. While Farwell’s attorneys paper the court claiming the government’s evidence is “insufficient,” Judge Casper explicitly found by a preponderance of the evidence that “Mr. Farwell caused the unavailability of the witness”. Judge Casper’s findings completely undermine the entire basis of this acquittal push: 🔹️She cited the critical testimony of Dr. William Smock, explicitly detailing that the physical evidence points to a “homicide not a suicide” to ground her decision. 🔹️She highlighted that the physical and digital evidence aligns perfectly, stating, “We have the video surveillance and the testimony we just heard today.” This ties Farwell directly to the room as the last person alive with Sandra, stopping her phone activity. 🔹️She pointed directly to the shifting dynamic before the murder, noting that “the relationship with Mr. Farwell was changing before her death” as Sandra became increasingly “incessant with Farwell about what she wanted.” Filing standard boilerplate motions overnight won't erase the fact that the court has already firmly stated Farwell likely killed Sandra Birchmore to silence her. The defense now enters their case completely back-pedaling against a devastating evidentiary record.
