She's a minor of 14 years The perpetrator is an adult. Read this letter with that in mind. Let's examine what the law and child protection frameworks say :- 1. Minors under the age of 18 cannot legally consent to sexual acts under section 8 of the Sexual Offences Act. 2. Under the Children Act 2022 and the Sexual Offences Act No. 3 of 2006, a child under 18 years old cannot legally give consent. 3.Article 53 of the Constitution and Section 8 of the Children Act require that the child's best interests and protection from exploitation remain paramount at all times. Let's talk about closing a defilement file and shifting blame onto a 14-year-old child by stating that she "voluntarily took herself to the suspect" . This represents a shocking failure of public duty and a direct violation of child protection rights guaranteed under Section 8 of the Children Act. Directing counseling for the child to desist while recommending no further action against an adult suspect enables child abuse and undermines criminal law enforcement is the highest form of victim blaming and to a child. How is child protection supposed to work when the very institutions mandated to safeguard minors are normalizing statutory rape, blaming victims and refusing to prosecute perpetrators? We demand immediate accountability, an urgent review of this decision and full protection for the minor involved. @ODPP_KE
