Roger Marshall sued more than 700 patients over unpaid medical bills. Now a former patient is suing him.
⚖️ On October 29, Meischa Zimmerman filed a proposed class-action lawsuit in Barton County, Kansas against Marshall and his former medical practice, alleging unlawful interest charges often 18% annually on patients’ medical debt.
💸 Marshall’s practice sued Zimmerman over $3,596 related to her daughter’s birth. The New York Times reports she was arrested three times for missing court dates in the collection case.
📄 Now she is seeking restitution and damages on behalf of affected patients. The complaint alleges:
▪️ Usury
▪️ Unjust enrichment
▪️ Breach of good faith and fair dealing
▪️ Breach of fiduciary duty
Kansas Law generally limits these interest rates to 15%, with exceptions for credit cards for example.
Marshall’s spokeswoman did not immediately respond to the Times’ request for comment.
