This week marks 3 years of genocide in Gaza, a genocide which continues today despite a ceasefire agreement made a year ago. At least 1,450 Palestinians have been killed since the ceasefire agreement, and more than 5,000 injured. Near-daily Israeli attacks continue. Israel continues to inflict on Palestinians conditions of life calculated to bring about their destruction. As another rainy season dawns on Gaza, Israel is still depriving Palestinians of adequate shelter, sanitation, medicine, food, and water. The restriction of essential goods all but ensures unnecessary suffering and death in the face of expected flooding, storms, cold, and illness. While the government of Canada has made limited efforts in regards to settlement expansion in the West Bank, its lack of meaningful response to the genocide in Gaza remains unacceptable. Instead of cutting diplomatic and economic ties with Israel, Canada is cracking down on Canadians’ right to debate Zionism and overpolicing anti-genocide demonstrators. Today and every day, we stand with Palestinians and the many principled Canadians who tirelessly advocate for a free Palestine.

For the first time, Public Safety Canada has stated explicitly that its definition of antisemitism includes opposing Zionism. As the Ministry that oversees enforcement agencies like the Royal Canadian Mounted Police (RCMP) and the Canada Border Services Agency (CBSA), this conflation is very alarming. As acts of right-wing extremism rise, including the recent abhorrent attempted shooting of an Ontario synagogue full of congregants on Yom Kippur, the Canadian government must ensure the safety of all Canadians to practice their faith in peace and participate freely in society without fear. Incitement, threats and violence can never be accepted. However, these incidents cannot be used as an excuse to repress legitimate political expression. Palestinian Canadians have the right to to participate fully in Canadian society, including civil and political discourse on issues that directly affect their families. They must be able to honour their relationship to their ancestral homeland and to name the political ideology that perpetuates their displacement and erasure, and they must be able to do so without fear of criminalization or discrimination. These are fundamental rights enshrined in our Charter of Rights and Freedoms. We are steadfast in our legal efforts to protect the rights of both Palestinian Canadians and those who stand with them in solidarity, and are exploring our options for responding to this dangerous conflation accordingly.

Canada appears to have granted Israeli Prime Minister Benjamin Netanyahu, who is wanted by the International Criminal Court, permission to fly through Canadian airspace on his way to the United States. The Canadian Prime Minister has previously said that Netanyahu would be arrested if he entered Canadian territory, and the ICC has clarified in past cases that "territory" includes airspace. Approving an overflight request for someone subject to an ICC arrest warrant directly contradicts that commitment. Government officials have justified the decision by calling the United Nations General Assembly "a critical forum for diplomatic engagement." But the time for diplomatic engagement has long passed. For the first time, the Canadian government has explicitly defined anti-Zionism as a form of antisemitism. This is an appalling capitulation to pro-Israel actors like CIJA and anti-Palestinian racism. Zionism forms the ideological backbone of Israel's state-sanctioned violence against Palestinians. Our government quietly redefining it as a form of bigoted hate against Jews as a group is both offensive and inaccurate, and it endangers all Canadians' right to freedom of expression. We call for an immediate retraction, acknowledgement of the incredible harm this mischaracterization does to Palestinian and Jewish communities, and a recognition of anti-Zionism as a legitimate political viewpoint grounded in social justice.

Today, Canada announced its intention to restrict trade on goods produced by illegal Israeli settlements, in parallel with 11 other nations. The Legal Centre for Palestine welcomes this announcement but laments that it took unprecedented levels of settler terror and the advancement of the E1 settlement block for Canada to adopt the policies necessary to curb Israeli settlement expansion. This action is long overdue, particularly in light of the International Court of Justice’s findings in 2024, which concluded among other things that the Israeli occupation is unlawful. The ICJ’s 2024 opinion on the legal consequences arising from Israel’s policies and practices in the Occupied Palestinian Territories stated clearly that states have a duty to abstain from economic or trade dealings with Israel concerning the Occupied Palestinian Territories; and to take steps to prevent trade or investment relationships that assist in maintaining Israel’s unlawful conduct. Canada has always correctly maintained the position that under international law, Israeli settlements in Palestinian territory are illegal. At the same time, Canada has historically been resistant to taking any action to stop the import of goods produced in these settlements, and even acted to protect these goods from scrutiny when the issue of wine produced in West Bank settlements being labeled as “Product of Israel” was raised before the Federal Court. In that case, the Canadian government took the shocking position that the West Bank could be considered Israeli territory under the Canada-Israel Free Trade Agreement. Canada’s announcement that it intends to restrict trade on goods associated with illegal settlements represents a significant and positive development in Canadian policy that brings Canada a step closer to alignment with international law. However, in light of the severity of Israel’s violations, Canada must take further steps, including the suspension of the Canada-Israel Free Trade Agreement, the examination of Canadian charitable funds used to support the establishment of settlements, and the enforcement of existing laws against foreign recruitment of Canadians into the Israeli military. Only sustained pressure across economic, diplomatic, and legal channels can save lives.

An interesting postscript to this exchange. Yesterday, outgoing Canadian Bar Association @CBA_News President Bianca Kratt, KC posted a reflection on the end of her term, emphasizing the responsibility of lawyers to defend the rule of law and advance justice. I responded with the comment below. I congratulated her on completing her term, agreed with her comments about the rule of law, and then respectfully raised what I believe is a serious issue: the CBA's extraordinary silence on Gaza. I pointed out the contrast with the CBA's willingness to speak about Ukraine and international criminal law, noted the ICJ and ICC proceedings concerning Israel and Palestine, and mentioned the efforts by CBA members and the Canadian Muslim Lawyers Association to get the organization to address the issue. I ended by expressing the hope that incoming President Loreley Chekay, K.C. and the new leadership would do better. There was no personal attack. No insult. No abusive language. It was a substantive criticism of a national legal organization and its record on an issue of international law. Today I discovered that Ms. Kratt has blocked me. I cannot tell whether my comment was also deleted or is simply no longer visible to me because I have been blocked, so I will not speculate about that. But the blocking itself is disappointing. When a public figure who has just completed a term leading Canada's largest national lawyers' organization invokes the importance of defending the rule of law, another lawyer should be able to respectfully question that organization's record without being blocked for doing so. And perhaps this small episode illustrates something larger. We talk freely about international law, war crimes, accountability and the rule of law when the subject is Russia and Ukraine. But raise the same principles in relation to Israel and Palestinians, and too often the response is avoidance, discomfort, silence — and apparently, sometimes, simply blocking the person raising the question. That is what many of us mean when we speak about a Palestine exception. The rule of law means very little if we are only comfortable defending it when doing so is easy. I am posting both Ms. Kratt's original post and my response so people can read them and judge for themselves.

Last week I reported on rabid Israeli extremist settler @arieh_king coming to Toronto & Montreal on August 25, 26-30. No corporate media has reported on this yet. How is this not a story? Canada condemns settlements but is allowing the architect of land theft to come here?
