Przecież to jest jakaś bolszewia. To uderzenie w wolność słowa i własność prywatną. Czegoś takiego w naszym prawie jeszcze nie było!
W skrócie - rząd Tuska wrzucił do Sejmu projekt o "środkach ograniczających" (druk 3003), który daje szefowi MSWiA możliwość nakładania sankcji na osoby i firmy za tzw. obcą ingerencję i manipulację informacyjną. Celem miało być wdrożenie unijnych przepisów, ale rządzący postanowili dołożyć groźne zapisy od siebie. Skutkiem może być NATYCHMIASTOWE zamrożenie środków finansowych bez uprzedniej decyzji sądu, a wniesienie skargi do sądu administracyjnego nie wstrzyma tego automatycznie!
Ilość ogólnych zapisów, które można szeroko interpretować wedle uznania jest zatrważająca. Podstawą do reakcji MSWiA może być zaledwie "prawdopodobieństwo wykorzystania środków finansowych", albo jeśli coś "mogłoby być na korzyść lub w interesie innych państw objętych sankcjami". Kto ma to oceniać, weryfikować, interpretować i na jakiej podstawie? To jest legislacyjne dziadostwo.
Rządzący próbują przepchnąć niejasne przepisy, które można w sposób uznaniowy wykorzystać do walki ze zwykłymi obywatelami, czy konkurencją polityczną. To jest nie do zaakceptowania. Aparat władzy nie może mieć wręcz totalitarnej siły nakładanie sankcji np. na przedsiębiorcę bez wyroku sądu, bo zanim ktoś taki przejdzie ścieżkę odwoławczą to może zostać przez kary zrujnowany.
Kary jakie przewidziano to nawet 20 milionów złotych czy 12 lat więzienia. Takie możliwości dają nieprecyzyjne przepisy, które władza może wykorzystywać! Jak mentalni komuniści biorą się za ochronę zagranicznej ingerencji w polską przestrzeń, to kończy się takimi niekonstytucyjnymi potworkami legislacyjnymi, na które nie wolno się zgodzić.
Zawsze będę piętnować cenzorskie zapędy i niebezpieczne gnioty legislacyjne. Apeluję do wszystkich o nagłaśnianie tej sprawy, bo rządowi Tuska chyba pomyliły się epoki!
