Customers of a crypto exchange that lost billions last week are being told to trust a promise they’ll be made whole. Under the Clarity Act, customer assets would sit with a qualified custodian, legally walled off from company money. Protection shouldn’t depend on a pledge.

Just turned my phone on after landing in London to news of the @binance hack, which is shaping up to be the biggest exploit in history. Reports put total outflows at about $5.9 billion so far and @cz_binance says losses could exceed $1 billion. One silver lining people keep pointing to: Binance, the world’s largest crypto exchange, has the resources to make customers whole. Stablecoin issuers also jumped into action quickly, freezing more than $1.5 billion in funds linked to the hack. Meanwhile, @BinanceUS is assuring customers it’s a separate entity from Binance Global and was not affected by the hack. Crypto has seen more than 200 security incidents this year, including Bitget’s nearly $388 million hack. The industry just can’t catch a break.
Looks like Binance just got hit by the biggest hack in crypto history. ~$1.8B frozen in USDC / USDT so far, so roughly $1.7B in unremediated losses. Thankfully, Binance is by far the most profitable exchange in crypto. They're good for it. This is considerably less than what they make in profit in a year. So no need to panic if you're a Binance customer. All of crypto is getting pentested right now. If you are under-investing in AI security / pentesting, now is the time to fix that.

🚨NEW: The @SECGov’s crypto custody proposal for investment advisers and regulated funds has landed. It includes allowing self-custody in certain cases and state trust companies to serve as custodians.
Since the advent of Bitcoin in 2008, the crypto asset market has grown from a niche curiosity into a multi-trillion-dollar asset class to which investors actively seek exposure. Unfortunately, our rules and regulations have not kept pace. To that end, today’s proposal would provide a clear regulatory framework for the custody of crypto assets, giving investment advisers and funds a compliant pathway where none existed before—and replacing the grey of uncertainty created by custody rules crafted for a bygone era.

Rumor mill is saying the SEC is gearing up to revamp KYC requirements so users only need to KYC once to access tokenized securities onchain. Our sources are saying this would enable composability across different onchain venues & tokenization platforms to let users clear more volume by splitting orders across venues using a zk based identity system.

🇺🇸UPDATE: CFTC now lets US brokers invest customer funds in TOKENIZED assets and keep records on-chain. CFTC staff updated their crypto FAQs today, adding four new answers and revising one: Tokenized investments: Brokers and clearinghouses can invest customer funds in tokenized versions of approved investments, if the tokens carry the same legal rights. Tokenized government money market funds are included, with a custodian's written acknowledgment. Swap dealers can now use tokenized money market fund shares as margin for uncleared swaps. On-chain records: Brokers, exchanges and clearinghouses can use blockchains to meet recordkeeping rules. Firms can keep records only on-chain, with no off-chain copy required. Firms on public blockchains must still be able to produce records if the network goes down. What's unchanged: Crypto, including stablecoins, still can't be used as margin for uncleared swaps. The questions came from dYdX, the Blockchain Association and the Solana Policy Institute. It comes two days after Chairman Mike Selig said US markets must prepare for "mass tokenization."
