I handled at least 1, possibly a couple more, injury grievances against the club when he was there. He is a hack. His resignation as the team doc was the best thing that ever happened to Chargers players.

The NFLPA can initiate an investigation. No need to call for one. Just do it. Might as well use the tools you have. CBA, Article 39, Section 5 (f): Separate from and in addition to the procedures set forth in Subsection (d) above, any player or Club, the League or the NFLPA shall have the right to commence an investigation before the [Accountability and Care] Committee concerning the health, safety or medical care provided by Club-affiliated personnel. Within 60 days of the initiation of an investigation, two or more neutral physicians (or other subject-matter experts) will be selected to investigate and report to the Committee on the situation. The neutral physicians shall issue a written report within 60 days of their selection, and their recommendations as to what steps shall be taken to address and correct any issues shall be acted upon by the Parties

CBA, Article 30, Section 3 (b) could be in play. Ineligibility For Termination Pay: (b) An otherwise qualified player will not be entitled to Termination Pay if (i) the Club terminated the player’s contract for Conduct Detrimental to the Club, and (ii) the Non-Injury Grievance Arbitrator determines that the player’s conduct was so severe that the maximum discipline for Conduct Detrimental of a fine equal to one week’s salary and suspension without pay for four weeks, pursuant to Article 42, Section 1(b)(xvii) of this Agreement (regardless of whether the Club imposed any such discipline prior to terminating the player’s contract), constitutes an inadequate remedy for the player’s conduct. First, player had to be terminated for conduct. Termination for conduct is an available check box on the termination notice. See, Appendix H to the CBA. If Club did not heck the right box, very interesting case to argue if club claim's conduct. If the term notice was checked as a conduct termination, and if reports are true as to the conduct, good luck getting an arbitrator to say the max CD penalty was sufficient discipline in response to going to get a gun to end an argument with another employee. Conduct termination also does not trigger any guarantees as $$ is guaranteed for skill, cap, and injury.

Possibly a little known fact. Sean Payton was a replacement player during the 1987 strike. That’s just a scabrous fact.

Hold Out vs. Hold In First, a Hold In is not a thing. If a club agrees to let a player report to camp and hang out while the 2 sides work on a contract. That is not a Hold In. That is just the sides working in good faith on a contract. Any player can be excused from any activity for any reason. 1/7

CD is up to 4 game suspension and 1 game fine. After 3 days, player gets a CD fine of $50k for days 4-6 CD fine of $100k for days 11-15 CD fine of $150k for 16-18 Game check ($300K) fine for 19-20 Plus, $250k in forfeiture. Total of $2m in fines. Of course, club could fine different amounts. Or club could even suspend the player. But that just hurts the club if they want him to play. And Club can elect not to collect some or all. 6/7

But, if considering max $ exposure, generally, far more $ at risk with a Hold In than a Hold Out. Only upside is that none of the fines are mandatory. In any event, neither are typically a good idea unless the 2 sides have a basic understanding before it happens. 7/7
