Since social media lawyers are weighing in on the constitutionality of the Ole Miss student section restricting LSU gear, I thought I might give it a go: 1. A ticketed athletic event is not a traditional “public forum” under 1st Amendment jurisprudence. Vaught Hemingway is a limited public forum, which changes the rules applied to restrictions on expression. I could argue that the student section, itself, is a non-public forum. 2. Universities are allowed under both Supreme Court and 5th Circuit precedent to create limited public forums and non-public forums and can create reasonable restrictions on speech consistent with the purpose of the forum. 3. The purpose of the student section is to create a concentrated home-cheering section. The remainder of the stadium is still available to people who want to express themselves as LSU fans do (by passing out before kickoff with the subtle aroma of corndogs wafting through the air). 4. Even if this was a traditional public forum, the announced restriction is a reasonable time, place and manner limitation under 1st Amendment law, specifically designed to preserve public safety. Fights erupting in student sections amid tense rivalry are nothing new. We needn’t even look outside of this rivalry. An adult LSU fan was arrested in the Ole Miss student section at a baseball game this spring for fighting. 5. Finally, there’s no reason to disrupt the sea of fine looking young men and women dressed in their dapper best with pockets of garish gold, jerseys and jorts. #HottyToddy
