Touhy would apply, and maybe already has been litigated during the investigation, to the state trying to subpoena people or papers from DOJ or DHS. The discretion to turn over either is usually left to top officials. I made Touhy decisions for our office.

TLDR: procedurally this case will be interesting for a short time, and at some point in the near future, assuming the case is removed to federal court. there will be a hearing if the case can move forward to trial. Expect appeals.
