Recalled Oakland Mayor Sheng Thao’s federal bribery trial starts next week. She is facing 95 years in prison.
On October 13, jury selection begins in Oakland. Opening statements follow. The case is expected to run about six weeks. Thao, her ex-boyfriend Andre Jones, and California Waste Solutions executives David and Andy Duong have all pleaded not guilty.
Prosecutors say the deal was cut before she ever took the oath. The Duongs would finance attack mailers against Loren Taylor and Ignacio De La Fuente and put Jones on a $300,000 no-show job at Evolutionary Homes. In return, Thao would commit Oakland to buying their shipping container housing, extend their recycling contract, and help install people they chose in city jobs.
When it became clear she was going to win, Mario Juarez texted Andy Duong, “So we may go to jail. But we are $100 million richer.” Duong answered, “Money buys everything.”
The payments to Jones started after that. The group discussed raising his cut toward $3 million if Oakland bought 300 units. Prosecutors say Thao proposed using emergency powers so the city could skip a normal bid. She later pressed the city administrator to put Larry Gallegos in housing even though he lacked the experience for the job.
Juarez was in the room when the deal was made. He pleaded guilty and is expected to walk the jury through what Thao agreed to and what she got in return. Bryan Azevedo pleaded guilty in a related case and is set to testify too. Staffers are expected to say they heard Thao tell David Duong that if the Vietnam reporting came out, she could no longer work with him.
Oakland voted her out by a majority. Next week the people who paid for that term will get to tell a jury what they purchased. – at Oakland, CA

Dramatic moments in Federal Court Wednesday as prosecutors played secret recordings of Evolutionary Homes board meetings.
You hear David Duong and Mario Juarez expressing frustration that then-Mayor Sheng Thao and her partner, Andre Jones, were not living up to their end of the bargain to buy container homes for the homeless, even though the Duongs paid Jones $85,000 to that point and he was asking for more.

ABC7 EYEWITNESS NEWS EXCLUSIVE -- key witness in the Sheng Thao bribery and corruption trial JUST arrived at federal court. Mario Juarez is the businessman, partner of the Duongs in Evolutionary Homes who spearheaded negotiations with Thao and her partner, Andre Jones.
Government prosecutors said earlier this week they didn't expect Juarez to testify until next week. Plans may have changed, and he could testify as early as today.
Day 10 of the Sheng Thao trial.
Former City Administrator Jestin Johnson took the stand and described how Sheng Thao personally directed him toward the Duongs’ modular housing company. She introduced him to Evolutionary Homes and encouraged him to tour the showroom in January 2024. After the visit he texted her that it was “quite informative,” even as he flagged the cost and wrote, “We don’t have the money for this.” He photographed the units and sent the images to the city’s housing director.
Johnson also testified that Thao and her chief of staff asked him to meet with David Duong and Mario Juarez about their businesses. The conversations happened while the alleged deal for Oakland to buy the container homes was still being discussed inside Evolutionary Homes.
Former Assistant City Administrator LaTonda Simmons testified about Oakland’s emergency shelter ordinance, renewed in September 2023. The ordinance let the city administrator expedite certain homelessness projects and award contracts without the usual competitive bidding process. Prosecutors have pointed to that expanded authority as part of the pathway the Duongs expected Thao to open for their company.
The jury heard that the mayor who received campaign support and whose partner was paid by the Duongs was the same person steering her top administrator toward their housing venture. Johnson returns Friday. – at Oakland, CA
