🔴No deadline time limit in the The Disha-Sushant murder investigation. I've checked it out. The @bombaybench on 02-09-2020 gave the following orders to the @CBIHeadquarters : • Register an FIR • Appoint a senior officer • Record the father's statement • Investigate all circumstances of the death •Not treat anyone as an accused unless sufficient material emerges • File a chargesheet if an offence is made out, or a summary/closure report if not (with the family able to file a protest petition). The court simply told the investigating officer to file a chargesheet “at the earliest” if a cognisable offence is established, and, otherwise to file closure proceedings before the competent court. That is a direction to move promptly, not a dated cutoff. The FIR was registered on 13-09-2020. The “60 days” figure comes from the complainant’s lawyer, Nilesh Ojha, not from the court. In late September he said that, under the applicable rules as he reads them, the CBI had 60 days from the recording of Satish Salian’s statement for investigation, arrests, custody and a chargesheet. That reading mainly tracks statutory chargesheet timelines that matter when someone is already in custody. To date, nobody is. I'll stand corrected if someone brings forth anything credible.
