I have tried to explain the following several times over the last year and I'm going to try again as some are persisting with the idea there is no CAS equivalent in this process and they are wrong. Rule X.37 does indeed prevent a club from running to the High Court just because they don't like how a panel interpreted a specific football rule. Clear. But as City’s massive victory over the old APT rules proved, the Premier League cannot write handbook rules that override UK statutory law. If their rules constitute a legal definition of a "restrictive practice," the private tribunal must strike them down and if the tribunal fails to do so, the High Court remains the ultimate backstop. It's the difference between an appeal against a ruling (which Rule X.37 blocks) and a challenge to the underlying legality of the rules themselves. When Manchester City took on the Premier League over the Associated Party Transaction (APT) rules, they were not using Section X to "appeal" a punishment. Instead, they launched an offensive lawsuit using Section X as the required venue to test the legality of the regulations under UK Competition Law. This distinction reveals why Rule X.37's "No Outside Appeal" clause doesn't mean the Premier League is immune to the High Court. Why is this important? The PL know that City won't hesitate to test if any sanctions breach UK Competition Law. This is why Khaldoon's speech was perfect. It put them on notice, we ain't going to roll over and have our tummies tickled. City took them that far before and the league were humbled because they knew they'd lose in a real court. A real court scrutinising them is the last thing they want. The sanest option for the PL is impose sanctions that do not cross the threshold where they can be challenged against UK Competition Law. This should have a moderating effect on their sanctions discussions. I say should but Masters 'masters' may not allow it, he's their bitch, the decisions aren't his and they and their propagandists in the media are frothing at the mouth. I'm not a lawyer and am happy to be challenged on any of this. But given some of the absolute bollocks I've seen being talked about I had to try to make these points again, this is better than that and I hope some of you are better armed for the fight with this knowledge.
