DOPT should now issue the memorandum based on Supreme Court judgement with in 2 weeks.
After this all state governments should give corresponding OMs in all states.
Wherever recruitment notifications have been issued after the initial Rohith Nathan judgement date the creamy layer revised provision should be applicable .
Many OBC kids are being made to run pillar to post for getting creamy layer certificates. Since this decision affects lakhs of OBC candidates, all central and state government should set up single point source for reissuance of OBC Non Creamy layer certificate for eligible candidates within 30 days.
Already OBC vacancies are very less. They should be atleast a fair chance to compete and get jobs and succeed.
I have always wished that they should get government jobs and take care of their families and community interest equally.
But delay is the killer here

ओबीसी विद्यार्थ्यांच्या न्यायहक्कावर सर्वोच्च न्यायालयाने शिक्कामोर्तब केले आहे. क्रीमी लेयरच्या निकषांबाबत केंद्र सरकारची स्पष्टीकरण याचिका फेटाळून न्यायालयाने ११ मार्च २०२६ रोजीचा आपला निर्णय कायम ठेवला. हा निर्णय ओबीसी विद्यार्थ्यांच्या भविष्यासाठी ऐतिहासिक आणि स्वागतार्ह आहे.
केवळ पालकांच्या उत्पन्नाच्या आधारे गुणवंत ओबीसी विद्यार्थ्यांना आरक्षणाच्या लाभापासून वंचित ठेवणे अन्यायकारक आहे. स्वतःला ओबीसींचे कैवारी म्हणवणाऱ्या मोदी सरकारने विद्यार्थ्यांना न्याय देण्याऐवजी न्यायालयात याचिका दाखल केली, ही दुर्दैवी बाब आहे.
ओबीसी विद्यार्थ्यांच्या हक्कांसाठी आम्ही सातत्याने लढा दिला आहे. सर्वोच्च न्यायालयाच्या या निर्णयामुळे भविष्यातील भरती प्रक्रियांमध्ये विद्यार्थ्यांना न्याय मिळण्याचा मार्ग मोकळा झाला आहे. या ऐतिहासिक निर्णयाचे मी स्वागत करतो.

Those included in the “creamy layer” are not entitled to OBC reservation benefits. In March 2026, the Supreme Court had ruled that income cannot be the sole criterion to decide the OBC creamy layer.

Violations of reservation policies at IITs and Central Universities have reduced the number of faculty members from SC, ST and OBC groups. IIT Kharagpur has 20 SC, 46 OBC and two ST faculty members, against 236, 118 and 424 sanctioned posts, respectively. This is the tip of the iceberg and is not limited to IITs. In Central Universities, the data shocks me.
•OBC professor posts: 80 to 84% are vacant (only 84 filled out of 423 sanctioned).
•ST professor posts: 80 to 87% are vacant (only 24 filled out of 144 sanctioned).
•SC professor posts: around 64% are vacant (111 filled out of 308 sanctioned).
The constitutional bodies NCSC, NCST and NCBC have miserably failed in their duties and responsibilities. The manner in which the marginalised sections are sidelined points to a larger conspiracy to destroy the concept of reservation and social justice by persons at the helm of affairs. Heads of institutions follow the dictates of higher-ups and do not take serious steps to fill these vacancies. The Hon'ble Union Minister of Education, Pralhad Joshi @JoshiPralhad, has miserably failed to review these issues. How long can these posts remain vacant, denying lawful placements to marginalised communities and timely promotions? This requires a judicial probe by a commission of inquiry presided over by a retired Supreme Court judge to fix responsibility and impose departmental disciplinary action, in addition to criminal action under relevant laws. I appeal to the Hon'ble Prime Minister of India @narendramodi and the Hon'ble Minister of Education @JoshiPralhad to constitute a commission of inquiry in this regard.

The Supreme Court on Friday clarified its March 11 judgment on determining the creamy layer status of OBC candidates, while rejecting the Centre's plea seeking modification of the ruling.
The court reiterated that parents' salary income alone cannot determine a candidate's creamy layer status; the category of posts held by the parents must also be considered.
Clarifying the scope of its judgment, the SC said it would apply to the parties before it and that existing seniority and promotions would not be reopened. Pending cases will be decided by courts on their own merits and entitlement. The deadline to comply with the judgment has been extended by eight week

#WATCH | Chennai, Tamil Nadu: Advocate and DMK MP P Wilson says, "Today, the Supreme Court delivered a path-breaking judgment on the creamy layer issue, which virtually helps lakhs and lakhs of students hailing from the Other Backwards Classes (OBC) to get their rightful share in employment as well as in education...the 2004 notification proceeded on the basis that the salary income of the parents should also be taken into account while computing the income ceiling. In other words, if the candidate's parents' income reached 8 lakh rupees per annum, then the candidate became a creamy layer candidate and virtually lost their right to reservation in both education and employment. This 2004 clarification was against the 1993 office memorandum...today, the Supreme Court stated that it cannot grant two years and instead allowed only eight weeks' time. The Supreme Court affirmed in today's judgment that settled seniority or promotions cannot be reopened, but the judgment given on March 11, 2026, will be applied to the candidates who came before the court and fought their cases, entitling them to the benefits of the judgment..."

The Supreme Court on Friday (November 6) pronounced judgment on a Miscellaneous Application filed by the Centre seeking clarification of its March 11 judgment holding that the creamy layer status of an Other Backward Class (OBC) candidate cannot be determined solely on the basis of the parents' salary income, and that the category of posts held by them has also to be considered.
