Seeing some reporting that the Ayatollah was hit in the bombing. Pretty crazy to think world leaders might just wake up one day and get merk’d because we hit a new Epstein cycle in the news.

Happy to share that my paper, The Federal Reserve Exception, is forthcoming in @VandLRev! I question the strength of the Supreme Court's analogy of the Federal Reserve to the First & Second Banks, especially when it is compared to the ICC and 20th century regulatory agencies.

The argument that #SCOTUS is "reining in" executive power and (re-)empowering Congress is based on (1) cherry-picking the data; (2) downplaying the immunity ruling; and (3) ignoring dozens of other decisions to the contrary. Me, via a bonus "One First": stevevladeck.com/p/bonus-212…

I think the sheer audacity of the lie that the Roberts Court’s game is vindicating Congress has put off even centrist legal liberals. Y’all gonna have Vladeck out here with resistance y’all keep it up.

Legal liberalism’s schizophrenia in a nutshell. The Court is abetting centralized power in the presidency but is a necessary check on presidentialism? πŸ˜΅β€πŸ’«

I have a column today in Bloomberg about the tariff decision: By applying the major questions doctrine to Trump, the Court recognized the need for symmetry in the law, but it should also strengthen Congress's key check on unilateral administration, its power of the purse.

Fit for a paper talk in Boston today. We’ve got some pretty snow for the train ride over.

The in person SOTU is bad now and bad always. It is bad for our souls to see one man rise above all other aspects of the American state. A contingent and somewhat fascistic practice that should be abandoned pronto.

So I’m like of the Willis school on the Kennedys but don’t know much about JFK jr. Is the new fx show even in the ball park of how he was as a person?

1/x Really excited to say that my job talk paper, β€œRemembering Congress in the Myers-to-Humphrey’s Interregnum,” is coming out through the Pennsylvania Law Review. I am dying to work with Penn’s outstanding editors to bring this paper to the finish line. Thanks, y’all!

One problem with the Congress Caucus as a reoccurring phenomenon is that each generation sees itself as a self-contained entity. They don’t necessarily see themselves as the latest version of something much, much older. That lets you ignore the fact that your team has in some meaningful sense been losing over and over again since sometime after the Civil War. And *that* historical amnesia lets you maintain the same basic outlines of a reform package across time. It’s like playing for the Browns and having no idea what that entails.

One serious problem for article I is that the β€œcongress caucus,” the rag-tag forces who try to recenter article I over time cyclically, have gotten narrower and narrower in the scope of their ambitions, even as Congress falls further and further behind.

I don’t know man. Seems like half measures. Can’t reconstruct congress without deconstructing presidentialism and juristocracy. It’s a self-defeating task. Decentralizing power, etc, ain’t it.

Truly, there is not way to do MCGA (make Congress great again) without solving the core issue: it doesn’t make sense for people to do reconstruction if Congress is not the body that authoritatively resolves major political issues. Juristocracy and presidentialism CANNOT coexist with MCGA.
