When we adopted our new Constitution in 1996, we were incredible hopeful! The rollback of our rights since, has been a source of pain and great frustration.
It’s true, faith in our Constitution has never been lower but it’s still on our side and we must keep using it. There are many examples of legal wins: the coastal community case against Shell, the Section 27 case on clinic access, the affordable housing case in Cape Town, the case against the lack of public participation in the procurement act. When we use the courts to ensure our rights, we can win.
