The Supreme Court's new Term is in full swing, raising the familiar problem of precedent: When and why should today's Supreme Court overrule decisions of yesterday's Supreme Court?
My latest article, just published in the @PennLRev, examines this problem from a new lens. It argues that the Court's shift a century ago from mandatory to discretionary jurisdiction destabilized several procedural protections that existed against the abuse of precedent. With those procedural protections gone, the Justices have been forced to rely instead on the unsatisfying balancing test they use today.
While returning to full mandatory jurisdiction is not practical, I offer targeted reforms that can restore some of the procedural protections that used to guide courts’ treatment of precedent.

I have a new @SCOTUSblog essay today, which defends judicial review against a recent critique.
It's late October, and there are a lot of 1Ls who feel like they're not good at law and that their peers are much more advanced than they are. Just a reminder that it often takes longer for many 1Ls for law to "click"—it certainly took longer for me. youtube.com/shorts/k0Y1Z9tSY…

Jeremy Christiansen @TradVat2 with a third take on substantive canons
Substantive canons are all the rage.@joeljohnson13 says they are "legality" canons. @charlesfcapps says they aren't real.
For a classical defense of substantive canons, read my forthcoming article in the @SMULawReview. Long live the substantive canons!
