We should have spaces where we explore fully AI integrated writing/reviewing models.
These should be different from the spaces that humans currently use to communicate — literary scenes, op-eds, academic journals.
If the AI-integrated workflows are better, they will defeat these old media. But we shouldn't let it destroy the current institutions in advance in case it turns out to be worse.

"Consider each text on its own merits" sounds very good, but will not be possible when the quantity of text goes up 50x because of AI.
In any medium, AI writing and human writing cannot coexist in equilibrium.
it took a very long time, but Patrick Goold and I finally posted a preprint of "The Case of Snickerwood Soup" on SSRN.
We use Lon Fuller's "The Case of the Speluncean Explorers" as a way to analyze different theories of IP.

I would love to hear from tenured law faculty on the following questions:
How did you approach your scholarship after tenure? Did your approach change? How? Why?
This is an interesting paper on risk and how responses to it are shaped by community behavior

Maybe not representative but this is profoundly depressing

I've just posted a draft of my forthcoming article, Federal Malpractice. Plenty of time for comments, which are still filtering in.

Science editor-in-chief Holden Thorpe gave the day’s first warning about the rise of science in China.
He says he can see it in the papers researchers are trying to get published in the top scientific journal he edits.
"Submissions from China continue to increase, not just in number but in quality, and submissions from the U.S. are going down,” Thorpe said.
He later added: “The atmosphere there (China) is just so much more pro-science than it is here.”
Here is a video.

Doctors prescribe medications. But do they know if patients ever fill them? Often, no. Now add AI.
On our first How I Doctor Roundtable with @grahamwalker, Dr. Simon Chang from @eNavvi, Tanvi Patel from Amazon Pharmacy, Deepika Srivastava from @doctorscompany, & @david__simon from @Northeastern debate the future of prescribing.

Had a great time talking about AI and liability in medicine!
🚨 AI is now prescribing. So when AI picks the drug without a doctor in the loop and something goes wrong, who’s responsible?
Tomorrow, Offcall's @grahamwalker speaks with four people who see prescribing from different sides:
💊 Dr. Simon Chang, DO, internal medicine physician and founder of @eNavvi
📦 Tanvi Patel, VP and GM of @amazon Pharmacy
🛡️ Deepika Srivastava, COO of @doctorscompany
⚖️ David Simon, Associate Professor of Law at @Northeastern
Can we use AI to fix prescribing without taking the physician out of the loop?
🔥New ep out tm 7am PT / 10am ET

Happy 42nd anniversary to the greatest SNL short ever made!
Men's Synchronized Swimming.
Last week, I had the pleasure of doing grand rounds at USC Arcadia Hospital, where I discussed physician liability when using AI. It was a very engaged and enthusiastic group, and, as always, I learned a tremendous amount from fielding questions.
In my latest Substack, I explain the threat AI poses to copyright and why its historical strategy of absorbing new technology probably won't work.
