Jeffrey Epstein was not a lawyer. He was not anyone's client. What he understood, better than most actual attorneys, was how to weaponize a legal shield most people have never heard of. In 2012, at billionaire Leon Black's request, the law firm now known as McDermott Will & Schulte sent Epstein a letter retaining him as a paid "consultant." The fee was $500. That's it. But that $500 bought him something priceless: attorney-client privilege, extended to him through what's called a Kovel arrangement, a mechanism normally reserved for accountants and financial experts assisting lawyers on a case. The moment that letter went out, Epstein's calls, meetings, texts and emails on the matter became legally shielded, exactly as if he were an attorney himself. He didn't stop at one. Bloomberg found ten separate Kovel-style consulting agreements in the DOJ's released files, with references to four more, spanning firms including McDermott Will and Paul, Weiss, Rifkind, Wharton & Garrison. He knew the term well enough to use it casually in his own emails, misspelling it the same way every time. He once tried to extend the same privilege shield to Steve Bannon weeks before his 2019 arrest, over a documentary interview. Bannon never signed. And he wasn't just hiding behind the privilege, he was trading on it. Epstein referred wealthy prospective clients to these same firms: Bill Gates, Mort Zuckerman, Noam Chomsky, others. In exchange, one of the tax attorneys he worked closely with, Carlyn McCaffrey, called him "a good colleague" after he helped keep Leon Black's business flowing to her firm. Black himself ended up paying Epstein close to $160 million, more than 300,000 times the fee listed on that first letter, while trying to shield over a billion dollars in estate tax exposure. None of this happened by accident, and none of it required Epstein to break any laws to work. That's what makes it worse. He found the exact legal mechanism that lets money and connections manufacture secrecy, and he used it for years, with some of the most prestigious law firms in the country helping build the wall around him, one $500 letter at a time.
