What I'm trying to get to in this piece is not a legal conclusion - I'll leave that to the courts. It's a social, cultural, and moral one. What is the social penalty for treating another human being as sub-human, for engaging in behavior that you should reasonably understand is violating to a person who is not fully able to say yes, for using a naked drunk and drug-added drunk girl as a "free pussy" you and your friends bond over demeaning because it makes you feel cool and powerful? Even if no crime occurred here (a big "if"), is that the end of the story? It's the rightful end of any prosecution, but every society draws lines around right and wrong, and enforces them in ways that have nothing to do with the legal system. "Was it a crime?" is one question. But it's far from the only important question.

Men can choose to not do this. Men can choose to treat women the way they would like to be treated (I suspect that most men, when extremely drunk and high on ketamine and having reluctantly consented to some limited sexual activity, would not find it pleasant to have their condition advertised as “free ass” to random men on Snapchat). We can create a culture in which men who treat women this way are considered reprehensible, pathetic, and worthy of scorn, whether or not they have technically committed a crime.

EVERY YEAR on 9/11 I say a special prayer for Tu Anh Pham, whose first day back from maternity leave was 9/10/01. Her first & only baby was 6 weeks old that day, and she worked on a floor that took a direct hit from the first plane. Her funeral was more like a baby shower--sad, but also hopeful for her beautiful baby girl, who's now 25 and clearly has a lot of her very determined, wicked-smart and fabulous mother in her. Special prayer for her family tomorrow, please.🙏
