Breaking! Kerala High Court Sets Aside Kudale Committee Report on Coastal Erosion at Vizhinjam Port Orders Constitution of a Fresh Committee of Independent Experts In a significant judgment delivered on 30 November 2026, the Hon'ble High Court of Kerala has allowed a writ petition filed by 128 fishermen and other affected individuals who had lost their houses due to coastal erosion following the commencement of construction of the Vizhinjam International Seaport. The petition challenged the report of the Expert Committee headed by Mr. M.D. Kudale, constituted by the Government of Kerala to study the impact of the Vizhinjam Seaport on coastal erosion. The Court has set aside the Kudale Committee Report, principally on the ground of conflict of interest affecting the independence and credibility of the Committee. The proceedings highlighted that the Chairman, Mr. M.D. Kudale, had previously been associated with the technical sub-committee for the development of Vizhinjam Seaport. Questions were also raised regarding the professional associations of other members with entities having interests in the project. A significant aspect of the challenge was the contradiction between the Committee's conclusions and the Chairman's own published scientific paper, "Impact of Port Development on the Coastline and the Need for Protection." In that publication, Mr. Kudale had acknowledged that port construction involving breakwaters and dredging interferes with natural coastal processes, resulting in sediment accumulation on one side and erosion on the other. The Committee's report, however, attributed the observed coastal erosion substantially to Cyclone Ockhi. The Court has directed the Government of Kerala to reconstitute the Expert Committee with independent experts, in consultation with stakeholders, and undertake the study in accordance with the prescribed Terms of Reference. The judgment marks an important step towards ensuring independent scientific assessment of the environmental consequences of major coastal infrastructure projects. It underscores the importance of transparency, impartiality and scientific integrity in decisions affecting Kerala's fragile coastline and the livelihood and homes of fishing communities.

Last night IFF, @SFLCin and @geoblockedindia received a legal notice said to be issued purportedly on behalf of the RSS. It’s hard to believe this comes from an organisation that has had a century to practise its paperwork and hence this may even be a weird prank! This notice asks us to stop criticising the Government’s blocking orders and stop documenting them. It also wants us to confirm in writing within seven days (seriously). We can tell it’s an excellent teaching aid and here are seven lessons from it. 1) Say who you are: The notice names no advocate and gives no enrollment number. It is signed by an “Authorised Signatory” with no name. Replies go to a free Proton Mail ID, and the “office” is a residential flat in outer Delhi. A notice that can’t tell you who sent it is less a legal document than a weather event. 2) Have a grievance of your own: It never says how its client is harmed when we criticise a MeitY advisory. It complains on behalf of the Government’s blocking orders. The Union has no shortage of lawyers, and it hasn’t asked for volunteers. 3) Name the law: It threatens “appropriate legal action” under “the applicable provisions of law” and doesn’t cite a single section of any statute. A threat with no law, is literally an empty threat. 4) Don’t ask people to give up a fundamental right within seven days: The first demand is that we stop “publicly opposing” government directions. In Shreya Singhal (2015), the Supreme Court held that discussion and advocacy of a cause, however unpopular, sit at the heart of Article 19(1)(a). Opposing an order is how its legality gets tested. That is the Constitution working as intended. 5) Check whether the courts asked for the thing you want stopped” In Anuradha Bhasin (2020), the Supreme Court held that orders restricting fundamental rights must be made available so people can challenge them. The Reddit order is on the public Lumen Database because Reddit put it there. Reading a public database and saying what’s in it has a name. It’s called research. 6) Show us the spark and the powder keg: The notice says our work weakens national security measures, but it gives no instance, date or harm. In S. Rangarajan (1989), the Supreme Court held that the danger feared from speech can’t be remote, conjectural or far-fetched. It has to be like a spark in a powder keg. A post about a Lumen filing is not a spark. 7) Read it once more before you press send: The paragraphs run 1, then an empty 2 and 3, then 4. A PIN code wanders into the facts. The account it targets is on “Twitter”. Our reply is short. The notice is legally deficient because it makes no material allegation and cites no illegality. We will respectfully continue to advance constitutional rights, as we have done before. Notices like this rarely expect to win in court. They expect the recipient to get tired. We often are tired, but it has never changed what we do. Solidarity with @SFLCin and @geoblockedindia. If your post or account has been blocked in India, write to [email protected].

Kochi’s private buses keep the city moving, but their rush to reach destinations often puts other road users at risk. High-speed driving, minor accidents and near-misses have become common on the city’s roads. Watch @HarithaManav’s video

🚨The SIR has repeatedly been sold as an exercise to identify “illegal foreigners”. Data from at least six states shows only 1,600 found in a combined electorate of over 98 million. Also no standardised SOPs were issued which means several states didn’t even collect this data. @htTweets

Guwahati is turning into a place of lawlessness. The Bora Service incident is so tragic & triggering. Five shot dead, an entire family wiped out, two minor children orphaned. It’s reminiscent of Guwahati in the 90s, when militancy was at its peak and people lived in fear.

#WATCH | Kochi, Keralam: On investigation of Juvenile son of a Judge involved in a car accident in Cheranalloor, Kochi City Police Commissioner Kaliraj Mahesh Kumar says, "... Yesterday, early in the morning, the police received information about an accident. A police team immediately rushed to the spot, and the victim was shifted to the hospital. Unfortunately, the person later died. Initially, a case was registered under the section relating to death caused by negligence, based on the initial First Information Statement (FIS). However, during the investigation, evidence emerged indicating that the vehicle was overspeeding. Since the accused was a juvenile, the section was subsequently altered to Section 105 for culpable homicide. Initially, this evidence was not available. The section was altered, and, following the Juvenile Justice rules, the juvenile was produced before the concerned Juvenile Justice Board, and the prescribed procedures were followed. Moreover, the Motor Vehicles Act provides that when an accident is caused by a juvenile, the guardian or the registered owner (RC owner) may be held responsible. In this case, the father is also the registered owner of the vehicle. Accordingly, the relevant provisions of the Motor Vehicles Act have been invoked. Certain procedures must be followed because the registered owner is a judge, and we are following those procedures to take further action... This is an emotional moment. We fully support the family, as they have lost their breadwinner, who was working late at night when the accident occurred. We will take all necessary action to ensure that those responsible and found culpable are brought to justice, in accordance with the existing norms."
