NEW @Law360: Me and graphics wiz @FakeBenJay have created a site tracking #climatechange suits against #FossilFuel companies as they progress in the courts, with links to our latest coverage. It’ll be updated as case events happen, check it out: law360.com/climate-torts-tra…

New: I wrote about the renewable energy Super PAC @ITCoalition_PAC taking a victory lap after appearing to help oust Republicans, including Rep. Victoria Spartz I also asked about their 2028 plans... @heatmap_news heatmap.news/politics/invest…

My latest for @Law360: The chances of Congress passing #BAAJA permitting legislation plummeted as Democrats seized control of Capitol Hill in Tuesday's elections, and any related bill introduced in 2027 could look a lot different than the current version. law360.com/articles/2546138

See below.
The first chance to show that the days of Trump's "supplicant Senate" are over is Nov. 9th. Dems can demand a hearing and amendments to improve the deeply flawed BAAJA bill before it moves forward. Or, they can cave to Trump and agree to jam through his 400-page MAGA wish list - the most sweeping environmental/energy bill in decades - without a single hearing. If that happens after last night's Blue Tsunami, the word "supplicant" would be far too kind. politico.com/live-updates/20…

NEW: MAGA's "own private law firm" is going to be run by a Democrat. I talked to Texas Attorney General-elect Nathan Johnson, who plans big changes that will have nationwide implications: nbcnews.com/politics/2026-el…

Just now when asked what Democrats' approach will be to judicial nominees, Schumer said they want candidates like under Biden "who obey they law, who have fidelity to the rule of law." He added, "Too many of Trump's nominees did not have that at all."

I assume there will be no court of appeals confirmations until at least January 2029, but it will be interesting to see if there are deals cut to try to fill judicial emergencies or other district court vacancies.

I spoke with Colom about that for this piece: law360.com/articles/2529284/…
Only the Judiciary Committee nerds will truly appreciate the fact that Scott Colom is only a Senate candidate because Cindy Hyde-Smith did not return a blue slip on his District Court nomination.

On transmission, utilities are seeking changes to a provision letting states refer utilities to FERC for investigation if they believe local transmission projects aren’t in the public interest. They want narrow definition of which state entities can bring a complaint

Former FERC legal adviser @YangEnergy told me this part of the provision might spark the heaviest pushback from utilities.

The Trump administration says these types of projects are the easiest to move quickly, but Dems say it isn't enough. The WH says more approvals are coming, but they appear to be holding off on approving large-scale new wind projects to maintain political leverage

THREAD: Just one reporter’s observation, but an item that may be getting lost in discourse over BAAJA and its impact on NEPA is that federal courts and agencies are already applying, and with increasing frequency SCOTUS’ Seven County decision.

For example, one question raised in my recent story on BAAJA funneling more claims to appeals courts is whether they might be overwhelmed by NEPA litigation. Seven County could play a major role in answering that question.

Anyway, something to consider when discussing BAAJA and the future of NEPA. /end

So I've seen a lot of people who oppose the bipartisan permitting bill excitedly sharing this story. Funny because many of these voices also loathed and opposed the big permitting deal Podesta previously negotiated. And Podesta said they should modify the deal, not spike it.
SCOOP: Former Biden senior climate advisor John Podesta said senators should renegotiate the bipartisan permitting deal & he believes the bill’s permit certainty language hands Trump a “loaded Howitzer” to go after public lands. For @heatmap_news heatmap.news/politics/john-p…
