Lehrmann has tried to overturn the ruling that he raped Brittany Higgins “on the balance of probabilities”.
Yet the full bench of the court went further than Federal Court Judge Michael Lee, arguing it should have been found Lehrmann knew that Higgins did not consent to “sexual intercourse”.
The “on the balance of probabilities” is now a full bench probability.
