If you, like me, are obliged to read some or all of the amicus briefs being filed today in the big OpenAI MDL amicus brief-a-palooza, we made you a little treat. The fair use briefs are inherently fun, of course, but the plaintiffs' briefs are a slog. So I made a thing.

🎃 What do Halloween costumes, movie parodies, and fan art all have in common? They rely on fair use.
Every October, creators breathe new life into classic monsters and pop culture icons through parody, commentary, and transformative art. Fair use ensures that copyright law promotes creativity rather than stifling it, allowing fans and independent creators to celebrate culture without facing legal scares.

Quad9’s decision illustrates the issues with site blocking and how the actions of European regulators and courts, in this instance intended to fight piracy, can affect the privacy and security of millions of users.

#SiteBlocking

How do reporters uncover corruption, trace lobbyist money, and expose discrimination? For 20+ years, web scraping has been the hidden engine behind investigative journalism.
Broad crawler bans, like those proposed in the Stealth Bot Prohibition Act, risk shutting down the very tools newsrooms use to hold power accountable.

As #OAWeek comes to a close, we thank Re:Create member SPARC for organizing a great week! 👏
This year’s theme, "The Cost of Knowledge," shows why open access and fair use are essential for the common good. Let's keep knowledge open!
Site-blocking frameworks are failing abroad, and the U.S. shouldn't copy their mistakes. @torrentfreak reports that Quad9 is exiting France over blocking orders, the second DNS resolver to leave after Cisco's OpenDNS.
Forcing DNS into copyright policing degrades internet security. Check-out our one-pager : recreatecoalition.org/infogr…

CCIA asked a federal court in Concord Music v Anthropic to affirm that training #AI models on copyrighted song lyrics was #FairUse. CCIA’s argument was straightforward: AI training is transformative because it uses works to learn patterns and build new tools, not to substitute for the original works. Fair use exists to protect precisely this kind of innovation. buff.ly/YOskutM

In January 2025, we sent a letter to @SenBlackburn outlining concerns with the Senate version of VACRA. Yesterday, @RepBenCline introduced a companion bill in the House, and our concerns still stand. VACRA risks:
• High financial and administrative costs
• Disrupting the Copyright Office’s ongoing IT modernization with heavy technical and administrative burdens

In the inaugural post, @bc_butler shares expert insights on why AI copyright “transparency” bills like CA AB 412, TRAIN, and CLEAR are fundamentally unworkable, arguing that such mandates are impossible without a comprehensive system of copyright formalities. recreateideas.substack.com/p…

So, you may have heard of this hot new platform called...Substack? We may be a little late to the party, but we're coming out swinging with thoughts on how maybe the boring-est part of the '76 Copyright Act is maybe having some big consequences in the AI age.
50 years ago today, the Copyright Act of 1976 was signed, officially writing #FairUse into statutory law! 🎂⚖️
While signed into law for half a century, fair use has long been the engine behind remix culture, documentary filmmaking, search engines, and the digital economy. Let’s celebrate 50 years of balanced copyright that protects both creators and innovators!
As a recent DOJ filing in NYT v. OpenAI states: forced licensing fees “would disproportionately benefit legacy media.”
A new blog by Re:Create member @RSI highlights how fair use is crucial to ensure local news journalists can access and afford vital AI tools: rstreet.org/commentary/local…
Journalists have used web scraping for 20+ years to expose corruption, track lobbyist influence, and reveal discrimination.
Broad crawler bans such as the Stealth Bot Prohibition Act risk cutting off the exact tools newsrooms use to hold power accountable.
