Utah sent an undercover agent to place about $115 in sports bets on Kalshi. Now the two people who started Kalshi are charged with 13 felonies, and the top charge alone carries up to 15 years in prison.
The day after the charges came down, investors gave Kalshi $1 billion.
Here's how the sting worked. In September, a special agent with the Utah attorney general's office opened a Kalshi account with a Utah address, a Utah phone number and a Utah debit card. Before his first bet, $10 on the Cowboys against the Giants, the app asked him to confirm his location. He told it he was in Utah, and it took his money. He did that 12 times over 11 days, on games like Utah vs. Utah State and a Real Salt Lake match.
Kalshi's cut on each bet was somewhere between 3 and 78 cents. So the company made less than $10 off the bets Utah is now using to go after its CEO and COO personally. And that top charge comes from Utah's racketeering law, the same kind of statute prosecutors use on organized crime.
The obvious question is why Kalshi didn't just shut off Utah. It clearly knows how. It already blocks Nevada and Washington because a settlement and a court order made it. DraftKings pulled its sports and politics markets out of Utah the same night the charges were filed, FanDuel did it the next day, and Fanatics shut down everything there on November 4.
Kalshi stayed because of how the company is built. DraftKings runs on licenses from gambling regulators in more than 20 states, so when one state comes after you with criminal charges, you get out fast and protect the rest. Kalshi has exactly one license, from a federal agency called the CFTC. Its whole $40 billion valuation depends on the idea that this one federal license overrides state gambling laws, and quietly walking away from Utah would cut against that argument everywhere else.
The federal government is backing Kalshi on this, and pretty aggressively. The CFTC and the Justice Department sued Utah two days before the charges. Their complaint says that if Kalshi turned away Utah residents, it would be breaking a federal "impartial access" rule that requires exchanges to serve everyone.
So the founders are stuck. Utah wants them to stop taking bets from Utahns or face prison, and the federal government is in court saying they aren't allowed to stop.
This goes way past Utah, too. The CFTC has sued 10 states since April. On the other side, 37 states signed a brief backing Utah in its appeal.
Sequoia and Wellington, who co-led the $1 billion round, are betting on one legal question, whether federal commodities law beats state gambling law. If the courts say yes, Utah's criminal case could fall apart along with every state lawsuit against Kalshi. A federal judge in Utah already said no back in August. The 10th Circuit is up next, and this looks like it's headed to the Supreme Court.
Kind of fitting for a company that lets you bet on almost anything that its biggest investors now have $1 billion riding on how a court case turns out.

The election is over. The market called it hours ago.
Objectively, it's an undisputed Democrat "sweep" all the way across the board.
The Republicans have lost control of both the House and Senate.
Meanwhile, Texas' US Senate and Governor races are set to flip blue for the first time since 1988 and 1990, respectively.
The defining issue for voters? Affordability.
The ongoing energy crisis has further fueled the affordability crisis, renewed interest rate hikes, and accelerated the K-Shaped economy.
US oil prices have now traded above $100/barrel for 46 days in 2026.

BREAKING: Europe is under a massive cyber attack, with supermarket fridges and freezers in Belgium, Sweden, Luxembourg, Ireland, the Netherlands, Finland and Estonia all hacked today by raising temperatures to up to 50°C, destroying huge quantities of food, per Reuters.
"Everything is destroyed," a sales manager in Sweden said, adding that "there has been a cyberattack and all our freezers reached 50 degrees."
More than 40 supermarkets in Belgium and Luxembourg were affected. "I only have two words for them: wake up, please, because there's something going on," a store manager in Belgium said.
This follows a similar cyberattack last month that hit hundreds of supermarkets in France, raising freezers as high as 80°C and causing major food losses.
It also comes after freezers at 6 US military bases mysteriously malfunctioned, spoiling large quantities of food, which the Pentagon is investigating as a suspected cyberattack.

BREAKING: NYT reports that operatives with Democratic Alaska U.S. Senate candidate Mary Peltola’s campaign were behind the effort to find & recruit a candidate named Dan Sullivan to run against incumbent GOP Senator Dan S. Sullivan in an effort to confuse voters and peel votes from him.
Specifically, NYT says they have reviewed text messages and documents that reveal in summer 2025, a Peltola staffer received instructions from campaign staffers to find as many people named Dan Sullivan in Alaska as possible.
The staffer complied, going through voter records, and compiled a list. The operation “involved secret trips to far-flung Alaskan communities and the appearance of a mysterious Midwestern operative, who traversed the state using a fake name and made his pitch to would-be candidates over beers at brew pubs.”
Per NYT:
“The plan worked. This spring, a retired teacher from a tiny fishing village along the Alaska Panhandle, reachable only by air and sea, announced his candidacy for Senate. His name was Dan J. Sullivan.”

Reddit's earnings call has exposed the new reality for thousands of companies.
"AI mode does not drive traffic. Not for us and not to anybody as far as I know. It used to be a traffic driver. Now it's not." - Reddit CEO.
The reality is that AI is fundamentally changing the way that humans access the internet.
Just 24 hours prior to this statement, Google's stock erased -$480 billion on the same issue: AI is disrupting the traditional search model.
For decades, the internet operated on a simple model. Search engines directed users to websites, and those websites monetized the traffic.
AI is destroying this business model, and it's happening at an accelerating pace.
The traditional model of internet traffic is rapidly becoming outdated.
The internet has entered a new era.

TRANSLATION:
I address the Brazilian people and the international community as the leader of Brazil.
First of all, I wanted to thank President Milei for his courage, sense of justice, and legality, and President Trump and the wonderful American people for welcoming me. This is a land of freedoms and brothers who share the same values as the good people of my country. President Trump is a great defender of freedom of expression.
On Sunday night, I watched in astonishment as an electoral fraud took shape before my eyes. The illegitimate and illegal action of Lula’s former lawyer allowed a mathematical impossibility to become reality and Lula to add more than 10 million votes from the first to the second round. A decision by the STF, made over and above the competence of the TSE, extended voting at the last minute, and the order only arrived after the end of the legal hours, when the ballot boxes were already closed. Voters were subjected to different rules. So far, the TSE has limited itself to defending the extension of the hours and there is not even a single credible response. And the nullities are not the only problem. Throughout the entire campaign, there was abuse of political and economic power and use of the public machine in favor of reelection. These are serious facts, expressly prohibited by law, that justify the annulment of the Lula-Alckmin ticket.
The regime’s response to my questioning came quickly. As if according to a previously prepared plan, seven minutes after this repugnant electoral fraud, the judge, implicated in an immense corruption scandal, directly cited in the inquiry he used to try to seize my passports, and who most likely would be in prison if they had not prevented my inauguration, set in motion the regime’s machine of political persecution. Being barred from the outset and completely suspect to initiate any judicial proceeding against me, his mere participation in procedural acts shows the extent of the arbitrariness and illegality underway.
It was not my intention to leave my homeland, but I know exactly where this is going. This is the classic playbook of any coup d’état. The political persecution that began with my father, former President Jair Bolsonaro, and spread to thousands of other ordinary Brazilian patriots and even American citizens, has a single objective: to silence anyone who does not agree with the state of exception installed in Brazil, through a Supreme Court packed by the petista criminal organization.
To be clear, there is no arrest warrant against me, because I have not committed any crime. What exists is a politically motivated witch hunt, which aimed to place me as a hostage and object of blackmail to protect the corrupt judges of the Supreme Court from impeachment. This is the script of the persecution: seizure of passport, electronic ankle monitor, censorship, house arrest, sham trial, and finally political conviction.
I will not subject my family to this and my country does not deserve to go through this international embarrassment again. Faced with the political instrumentalization of Justice in Brazil, I brought my family to the United States, where we are safe. I thank, once again, President Trump and the American government for welcoming us and giving us the legal security that we no longer have in Brazil.
I want to make it clear: I did not flee Brazil, I left for Brazil, I left a regime of exception to be able to be the leader that my people deserve, because silenced, imprisoned and censored, as my father is, I could not be that leadership and we would be handed over to the institutional theater of an opposition castrated and controlled by a Supreme Court full of servants of the regime.
