I largely agree with @paulg here: the most qualified person should get the job. And I’d go one step further. If policymakers try to force companies to ignore merit, productivity or market economics simply to satisfy a nationalist hiring preference, the costs don’t disappear. Companies automate, offshore, hire less or become less competitive. You can absolutely fight H-1B abuse. You can enforce wages. You can punish companies that game the system. But “hire the American even when someone else is better” is not meritocracy, and trying to legislate away competition is not capitalism. Very dangerous for America.
