Time-Bound Enforcement

मुख्यमंत्री, उपमुख्यमंत्री की नगरविकास खात्याचे अप्पर मुख्य सचिव श्री असीम कुमार गुप्ता?
शासनाला चार थेट प्रश्न:
१. अप्पर मुख्य सचिवांच्या अँटी-चेंबरमधून नगरविकास खात्याचा कारभार हाकणारे श्री नवीन माखिजा नेमके कोण? कोणत्या पदावर आणि कोणत्या अधिकारात ते SRA च्या बैठकांना हजर राहतात आणि श्री गुप्ता यांच्या शेजारी बसतात? श्री माखिजा आणि श्री गुप्ता यांच्यात कोणतेही आर्थिक हितसंबंध नाहीत, असे शासन जाहीरपणे सांगेल का?
२. DCPR २०३४ च्या विनियम ३३(११) मध्ये बदल करून SRA च्या बेकायदेशीर परवानग्या 'नियमित' करण्याचा घाट घातला जातोय, अशी चर्चा आहे. हे खरे आहे का? आणि यात श्री माखिजांची भूमिका काय?
३. मुंबई मनपाच्या अधिकारांवर अतिक्रमण करून, अधिकार नसताना, SRA विनियम ३३(११) अंतर्गत परवानग्या देत आहे. शासन हे तातडीने थांबवणार, की डोळेझाक करून विकासकांना मोकळे रान देणार?
४. SRA चे अध्यक्ष म्हणून माननीय मुख्यमंत्री ३३(११) खाली बुडालेल्या हजारो कोटींच्या महसुलाची वसुली करणार, की जबाबदार अधिकारी आणि विकासकांना पाठीशी घालणार? आणि या परवानग्यांचे सर्वात मोठे लाभार्थी विकासक कोण - ती यादी जाहीर करणार का?
मनपा आयुक्तांची पत्रे (२०२४-२६), १५ ऑक्टोबर २०२४ चा शासन निर्देश, उच्च न्यायालयाची निरीक्षणे - सारं काही रेकॉर्डवर आहे. बाकी आहे ते फक्त शासनाचं उत्तर.

SRA ३३.११ मधे भ्रष्टाचार थांबवा
महानगरपालिका आयुक्तांचे स्पष्ट निर्देश
वरील सर्व परिस्थिती लक्षात घेता, SRA आपल्या अधिकारक्षेत्राच्या पलीकडे जाऊन विकास परवानग्या देत असल्याचे स्पष्ट होत आहे.
त्यामुळे आपण संबंधित SRA अधिकाऱ्यांना तातडीने खालील निर्देश द्यावेत:
SRA च्या अधिकारक्षेत्राबाहेरील विकास परवानग्या देणे तात्काळ थांबवावे.
अधिकारक्षेत्राबाहेर जाऊन यापूर्वी दिलेल्या विकास परवानग्या मागे घ्याव्यात.
भविष्यात अशा प्रकारच्या परवानग्या देऊ नयेत.
कायदेशीर गुंतागुंत आणि भविष्यातील वाद टाळण्यासाठी तातडीने आवश्यक ती कारवाई करावी.
या पत्राचा महत्त्वाचा निष्कर्ष
या पत्रामध्ये BMC आयुक्तांनी SRA च्या अधिकारांबाबत अत्यंत महत्त्वाची भूमिका मांडली आहे.
आयुक्तांच्या पत्रानुसार:
SRA ला संपूर्ण मुंबईत विकास परवानग्या देण्याचा अमर्याद अधिकार नाही.
SRA चे अधिकार झोपडपट्टी अधिनियमांतर्गत घोषित केलेल्या क्षेत्रापुरते मर्यादित आहेत.
DCPR 2034 मधील नियम 33(10) आणि 33(11) अंतर्गतच SRA ला संबंधित विकास परवानग्या देण्याचे अधिकार आहेत.
नियम 33(19), 33(12)(B) आणि इतर नियमांनुसार परवानग्या देण्याचा अधिकार BMC चा आहे.
अधिकारक्षेत्राबाहेर दिलेल्या परवानग्या मागे घेण्याची मागणी आयुक्तांनी केली आहे.
