Pre-order my book! "A myth-busting glimpse into the inner workings of the Supreme Court." Fun for lawyers and non-lawyers alike, including John Jay's head injury, why the end of the filibuster is bad for the judiciary, and who is watching Slow Horses. penguinrandomhouse.com/books…

How Worried Should We Be About Threats to the Midterm Elections?
See this New York Times "Interesting Times" podcast/interview I did that's out today with Sarah Isgur, @whignewtons.
We address the range of concerns many have about about potential issues that might disrupt the normal election process.

I don’t think any photo could do more to prove how successful Indian immigration/assimilation into the U.S. has been, and yet somehow this is what gets the retard right mad???

The hijackers of both planes would have seen these children in the waiting area and in their seats. Neither flight was full and it would have been obvious. But to them, the sacrifice of toddlers was part of a pious religious observance, by which they would go to paradise for the punch they landed against Western Civilization by blowing up children going to Disneyland. In a final act of anti-Western, anti-Semitic, Islamist fanaticism, they bathed ritually, read the Qur'an, prayed together, and murdered these babies.

Osama Bin Laden: I am killing you because you have constitutional freedoms instead of living under Sharia Law.
Kavanaugh: he opposed American freedoms
Hasan: HOW DARE YOU
This is child-like ignorance and inanity and embarrassing to see from a Supreme Court Justice. We are governed by right-wing idiots at all the highest levels of our government.
Readers added context they thought people might want to know
Osama Bin Ladens manifesto: "You are the nation who, rather than ruling by the Shariah of Allah in its Constitution and Laws, choose to invent your own laws as you will and desire. You separate religion from your policies..."

This is the Republican nominee for statewide office. Are other Republican elected officials going to condemn the intolerance and racism, or look the other way while it becomes normalized. This is how great political parties self-destruct. Sad.

I don't think a consequence of doing your civic duty should be to have every misdeed of your life dredged up and blasted out to the public. Shame on NBC for running this and shame on us for having an appetite for it.
EXCLUSIVE: The holdout juror in the Lindsay Clancy trial had a history of domestic violence allegations, the @NBC10Boston Investigators have learned through court documents and interviews with family members.

Many thanks to the dozens of Arkansas attorneys of all political persuasions who signed this letter in support of Judge Lee Rudofsky’s nomination to the Eighth Circuit. We have worked with him every day for more than 10 years and can attest to what a great judge he will be.
Capitalism: people who don’t know each other cooperating through voluntary contributions of labor, ultimately achieving benefits for themselves and even the whole stadium. 🌭

Hard to think of a better advertisement for fascism than telling people GLP-1 drugs are fascist
🚨 Da’Shaun L. Harrison at Socialism 2026 argues that the political deployment of GLP-1 drugs is “fascistic” because they exist in “a world fixated on genociding fat people.”
“The political deployment of GLP-1s is fascistic, not because individuals take them, but because the conditions under which they become necessary are shaped by a world fixated on genociding fat people.”
And to explain why that is supposedly fascistic, Harrison turns to Frantz Fanon and “Black flesh under colonial surveillance.”
If GLP-1s are already “body fascism,” the dual and triple agonists are going to require an entirely new theoretical vocabulary.

"Capitalism is why people have to work" is very silly thing to say, but it's part of a grand tradition of blaming literally everything, no matter how absurd, on capitalism.

This is a better way to visualize Columbus’ voyages than the traditional way (that shows him traveling through a modern map)..
It looks a lot crazier and more daring when you see it as a trip into the unknown.

It was good to hear Thomas hyping up Justice O’Connor on Ted Cruz’s podcast. “She doesn’t get the credit she deserves.” Very true I think, especially considering the state of the Court when she got there.

People are under-pricing the possibility of a black-swan-esque event where significant chunks of higher ed collapse suddenly. At some point parents will decide they will not pay $100-400k combined for their kids to cheat their way through college. I expect a bang, not a whimper.
Higher ed has been contracting for a decade. Depending on how you count, around 100 or more four-year institutions have closed in that time. The closures and mergers are likely to accelerate in the next ten years. A range of 2-300 more seems very possible.
