This piece, especially in its statement that "Whelan and I corresponded [several months ago] about Schiltz," gives the wildly false impression that I supported Josh's charge that Judge Schiltz isn't a conservative. In fact, I repudiated Josh's charge.
Schiltz and I were law-school classmates and law-review colleagues. Here is part of what I wrote to Josh: "Pat has always been a strong conservative. Probably regarded as the most conservative member of the board of editors of the law review (which included Miguel Estrada and me). Very much a Reagan working-class conservative."

I will note that Josh Blackman has added a clarification of sorts to his post. But he continues to state that his "takeaway" from a Confirmation Tales post that I did is that "Schiltz had no public conservative bona fides at Harvard Law School." I thought that I had made clear to him that his takeaway was wrong.

By the end of this year, 109 of the 179 federal appeals judges--61%--will have been appointed over the last 10 years. And many of these appointees (both by Trump and by Biden) have been very young. So don't expect a high number of vacancies to open up over the next 10 years.
