Activists and councillors seem to have forgotten a key Court of Session judgement... this is not a loophole its an unlawfully applied policy. bbc.co.uk/news/articles/c1r2…

They can put any number on. Our licence number was put onto an ad online for a property we don’t own. No one is checking and no one cares. The system does not work.
Isn’t it already a requirement for adverts to include the licence number? The failure is the portals not requiring one to publish an advert.

Our licence number was put on someone else’s property ad. Visitors don’t care & there is no effort to police any of it. Like making people get a drivers licence and never having to show it. Would people stop driving? What did @Edinburgh_CC think would happen?
We have long asked for it to be a requirement that licence numbers be put on adverts to ensure that legal and illegal short-term lets can be clear. The enforcements, including prosecutions, must be proactive and penalties need massively increased to change anti-social behaviour.

& yet @Edinburgh_CC take no action instead going after paid up licensed small independent STLs paying the levy who fail planning stage despite no change of use & zero neighbour complaints or objections. The licensed are easy to find. Too much effort to go after the black market
Unscrupulous businesses owning multiple flats in a stair are forcing remaining owners out due to noise disruption etc. Also these unlicensed flats don’t pay Visitors Levy giving them an unfair advantage over licensed flats. Many also use resident waste bins not commercial waste

Excellent thread. They won’t go after the black market because it’s now too big they don’t have the resources or manpower. What did the policy makers at @Edinburgh_CC think would happen? Anyone know? Serious question
Many organisations warned the @scotgov that there was plenty of potential to create unintended consequences with the introduction of Short Term Let legislation. This has now happened... in spades. @Edinburgh_cc, only a few years ago, claimed to have 12 to 14 thousand (1/9)

@Edinburgh_CC's councillors have reduced self-catering to just 1,354 full time secondary letting licences. Down from a claimed 12k as recently as 2022. But it seems the black market is booming to fill the void & they will not be paying VL or meeting H&S rules. #SaveSC
This is the reality that no politician seems willing to tackle, or even address, whilst the bureaucracy continues unabated & costs continue to spiral. #SaveSC

@edinburgh_cc Given how significant self-catering accommodation is for the success of #Edinburgh as a destination, why is there no voice on the Visitor Levy Forum for Edinburgh? #SaveSC @TheScotsman @heraldscotland @BBCScotlandNews @EdinInquirer

This sums up Edinburgh’s STL mess: 1,754 licensed secondary lets. 800 have been REFUSED planning permission. The same regulatory system can licence your business while the planning system says you shouldn't operate it. That isn't clarity or certainty. #SaveSC

One Edinburgh planning meeting: OFFICES → 23-suite APARTHOTEL: GRANT recommended. Residential flat → STL: REFUSE. Another residential flat → STL: REFUSE. Another: REFUSE. Another: REFUSE. If visitor accommodation itself destroys “amenity”, explain the logic. #SaveSC

Remember the headlines - 14,000 Edinburgh STLs? Council data later found 1,900 secondary-let licences. Only 168 properties had actual planning permission. 168 is just 1.2% of the 14,000 headline figure. Even the 168 includes cases like former OFFICES converted to STLs. #SaveSC

It’s a blanket ban of independent STLs; only the hotels and aparthotels owned by foreign investors get the green light. Meanwhile, the black market goes unchecked and unchallenged. They don’t care about resident amenity or tourism. It’s all about money.

So either: 1. @Edinburgh_CC made up the 12-14k to gain traction for their vendetta, or 2. It was correct and there are now 10k+ homes available( so why is there still a housing crisis?) OR 3. There are thousands of STLs not engaging with the system at all. So why are @CllrChasBooth et al relentlessly chasing 1443 properties who have tried to engage in the licensing system in good faith? This is such a blatant vendetta for optics: they don’t care about the unregulated black market at all.

@EdinburghGreens & @scottishgreens - using their buzzword 'loophole' to try to shut down licenced businesses operating before the control zone but ignoring unlicenced STLs with no planning & avoiding the vistor levy! Wee Chas & his vendetta! We see him & soon everyone else will!
Surely the more shocking statistic or ‘loophole’ if you will, would be the amount of StLs who haven’t engaged in the biased system at all and don’t have a licence and don’t pay the accommodation tax? @CllrChasBooth doesn’t seem interested in that. Any statistics for noise disturbance? No? Didn’t think so, because the vast majority come from long term residents not STLs. That pesky data doesn’t fit this ‘loophole’ narrative does it Chas? It’s a #blanketban by @Edinburgh_CC #SaveSC

Posting as a reminder of inflated nonsense that's been claimed in the past so we remember to take with a great deal of scepticism anything that is claimed in the present. Sort out the black market you created. 1,434 full time licenses in @edinburgh_cc is not the issue. #SaveSC

@ASSCnews has written to the @scottishgreens with an invitation to work together on short-term let regulatory reform. We welcome scrutiny of the current system. We also believe that scrutiny must lead to practical solutions. Our members have invested time and money in licensing, yet established, licensed businesses face uncertainty through inconsistent planning decisions. Meanwhile, some unlicensed operators continue to trade, undermining those who have worked to comply. We have consistently called for licensing and planning to be separated, alongside a dedicated planning category for self-catering through a new Use Classes Order. We need fair arrangements for established businesses, clear rules and effective enforcement. We recognise the importance of addressing housing pressures and sustaining communities. We also recognise the contribution self-catering makes to those communities, supporting jobs, local businesses and Edinburgh’s Festivals. We have requested a meeting with the Scottish Greens to explore common ground and help resolve the impasse between the @Edinburgh_CC and the @scotgov. We are ready to turn that dialogue into workable reform. Accurate data matters, particularly when it is being used to shape housing policy. We cannot accept an analysis that combines different categories of short-term letting, including home sharing, and presents them as secondary lets. Our latest analysis of the council’s register identifies 1,443 licensed secondary-let properties, representing approximately 0.5% of Edinburgh’s housing stock. We also question what happened to the repeatedly cited estimates of 12,000 to 14,000 short-term lets by The @Edinburgh_CC. If those figures were accurate and comparable, we should now be seeing evidence of more than 10,500 properties returning to residential use. Where is that evidence? We cannot treat a reduction in reported numbers as proof that permanent homes have been delivered. Read more / Listen to the radio / watch the TV segment: assc.co.uk/news/assc-respond… @ASSCnews
