With that said, this discourse is too interesting, even for my cheesekop. My 2 cents is, the magistrate's bail condition doesn't mean he overrules our Chairperson, akere?! Anything but. I believe the #MadlangaCommission's decision to stop persuing Carrim's testimony was an operational decision so that they wouldn't delay the proceedings any further. So the Magistrate is forcing Carrim to go back to Commission to say "I'm no longer evading you.. 😅I am done playing games. I'm at your disposal to formalize and conclude my testimony (be it to just sign & conclude his testimony, or to drag him back into the witness box)"..
And also, the 48hrs clock starts ticking only it he makes bail in Musina, right?! I wonder though - if he doesn't make bail, will be see him being escorted to the Commission like Cat Matlala was?!
Okay, now let me go see what's happening there by Tshwane House..

Under Section 60(12) of the Criminal Procedure Act, a magistrate may impose bail conditions considered necessary in the interests of justice. So the court does have legal authority to impose conditions aimed at securing compliance with lawful processes.
BUT HERE'S THE IMPORTANT DISTINCTION...👀
On 14 August, Justice Madlanga ruled that Carrim would no longer be required to testify and that the Commission would proceed on his March evidence.
A magistrate granting bail can't OVERRIDE that decision or independently reopen Carrim's testimony.
Requiring Carrim to contact the Commission and arrange an appearance is one thing. Compelling the Commission to receive further testimony is another.
If the condition conflicts with the Commission's earlier ruling, Carrim's lawyers can apply under Section 63 to have it clarified or amended.
Bagaetsho, we now have TWO decisions that must be reconciled!
Gareth Mnisi is so arrogant that he probably BELIEVERS WITH HIS WHOLE HEART & SOUL that he has, he can, and he will outsmart SARS and every Law Enforcement Agency in the Country. And that arrogance, ladies & gentlemen, is his biggest contradiction. #MadlangaCommission
