Good rundown on the basic facts about our absurd diesel deal by @mercoglianos. (Huge fan! Link below.) Bottom line: No president can waive Congress's Article 1 powers and rewrite a statutory embargo via OFAC. That's not how the Constitution works. @USTreasury and @SecScottBessent know this. IF CBP allows embargoed Russian diesel off those tankers, dozens of companies immediately have a cause of action against DHS for violating federal law. This is heading to a Supreme Court showdown if the White House pushes the issue. POTUS is attempting to override a BEDROCK Congressional power after a call with Vladimir Putin.
What an absolute mess, @NateSibley. When Trump instructed @SecScottBessent to greenlight Russian diesel imports without the authority to do so, he put @USTreasury and @CBP in an impossible legal bind. An @OFAC license cannot override a federal statute, because Congress took that power away from Treasury in this case. PL 117-109 enacted a blanket statutory ban on all Russian HTS Chapter 27 energy imports (including diesel) with zero administrative waiver authority. And you're spot on about CAATSA. Even if Treasury claims it can (somehow) license around it, any move significantly altering Russia policy requires a mandatory 30-day notice to Congress and a statutory freeze before taking effect. The end result? If a Russian tanker soon arrives at a U.S. port, CBP is legally barred from clearing the cargo.

Trump’s deal has failed? American companies are in no rush to buy Russian diesel Businesses are wary of the legal and reputational risks, The Washington Sun reports. Trump’s aides are privately urging companies to accept the shipments. Between October 16 and 22, three tankers — Talisman, Leruo and Agioi Fanendes — departed from the Russian port of Primorsk for the United States. They are carrying a total of 924,000 barrels of diesel. However, the vessels’ routes are already changing. Analysts estimate that the fuel could ultimately end up in Brazil. American politicians are also opposing the shipments. A bipartisan group of congressmen has warned banks, ports and distributors of potential legal liability for participating in deals involving Russian fuel. A 2022 law prohibits its import, and to lift the restrictions, the president must notify Congress 90 days in advance and meet a number of conditions. The expected drop in US diesel prices has also failed to materialize. Fuel is selling for around $6.30 per gallon — slightly more than when Trump and Putin reached their agreement.

“Defence startup Destinus has built more than 1,750 Ruta cruise missiles in Europe and now produces ‌more cruise missiles in a month than Europe did in a year before Russia's full-scale invasion of Ukraine, it told Reuters. The Dutch-headquartered company said monthly output of its Ruta missile had reached nearly 300 units. Chief Executive Mikhail Kokorich said he expects Destinus from next year to be able to meet demand across Europe, including Ukraine, for turbojet engines in the roughly 1.5-kilonewton thrust class used in cruise missiles. He said the company was already producing such engines in series and supplying them both for its own missiles and to other manufacturers… The company told Reuters it had begun production of the larger Ruta Block 2 missile, ‌which is designed to carry a 250-kg payload and travel more than 700 km. Unlike the current Block 1 version, the missile is designed to be stored, transported and launched from the same container, simplifying logistics for larger stockpiles… Kokorich also contrasted Destinus' China-free supply chain with wartime production in Ukraine, saying access to Chinese suppliers would make manufacturing ‘cheaper, faster, easier’ but that Destinus used no Chinese components.” reuters.com/business/aerospa…

Please follow this entire thread. Tucker Carlson is deranged. He accuses me personally of ignoring a US citizen allegedly attacked in Judea/Samaria by Israelis & says I "blew him off." Tucker knows how to contact me, but he'd rather make unfounded accusations than get facts. Here is a timeline of Embassy Jerusalem American Citizen Services' interactions on this case. We have never been able to speak directly to the father, (name redacted) who was allegedly injured in an attack by settlers, only to his son in Chicago, (name redacted). The son has repeatedly asked that he be the only person with whom we speak with. 19 Oct – ACS received an email from (son) alleging his father had been attacked at his home in Turmusaya by settlers and was now at Istishari Hospital in Ramallah. We called the son in Chicago the same day and asked for contact information for his father which he was unwilling to provide. We followed up the same day with an email to (son). 20 Oct – We followed up with another email to (son) asking for contact information. (Son) asked us to call him.  We called the son twice that day and there was no answer. We called the hospital in Ramallah several times but were unable to reach anyone. 21 Oct – Received another email from (son) saying his father was undergoing surgery at the hospital. We called the son in Chicago who said he would send contact information for next of kin in the WB which we didn’t receive. He stated he didn’t want to pursue the matter with the local authorities and said family members would travel from the States to the WB and wanted assurances they wouldn’t be denied entry at the airport. 22 Oct – We spoke again with (son) who subsequently wrote in an email…”Thank you for taking the time to speak with me and for your understanding regarding the tragic incident involving my father. Thank you again for your time, support, and assistance during this difficult time.”  We responded in an email that we would like to speak directly with his father or his uncle and asked for local contact numbers. We didn’t receive any numbers. We received another email that same day saying his brother and mother were traveling to the WB from the States and he wanted assurances that they would be allowed in. We also received medical reports and photos passed to us from the son showing the wounds of his father. 23 Oct – We called the hospital in Ramallah but were unable to reach the father. 26 Oct – We called the (son) in Chicago, but no answer. We left a message asking if the brother and mother had arrived and contact numbers for them. We haven’t received a response or contact numbers. Tucker, you can apologize when you find your conscience & acknowledge the facts.
Ambassador Huckabee, this is unreleased video of an American who was beaten almost to death last week by Israeli settlers. You know his name because he came to you for help, but you blew him off. That’s disgraceful. Do your job. @GovMikeHuckabee @SecRubio @davidamilstein @WhiteHouse

The warnings from @SenBlumenthal & @RepRaskin may discourage potential buyers of Russian diesel, importation of which seems prohibited by law. That’s a big risk the Trump administration is asking companies to take, w/o making a case for why the legal prohibition does not apply. @ACGeoEcon

🇺🇦🇪🇺⚔️Why does Sławomir Dębski’s description of diplomacy as a hall of mirrors, with everybody dutifully dancing to an orchestra playing out of tune, remind so much of Thucydides? It captures a recurring failure of statecraft that the ancient Greeks understood rather better than many of today’s European leaders appear to do. 📚It is a pattern that classicist Victor Davis Hanson repeatedly examines in his histories of Greek and modern warfare: the fatal confusion of an operational pause with a strategic settlement, of temporary relief with lasting security, and of diplomatic ceremony with political achievement. 📜Thucydides returns repeatedly to the contest between power, fear, honour, and interest. The political settlement must address the causes and incentives that sustain a war. Otherwise the cessation of hostilities is liable to become no more than an intermission, during which the protagonists replenish their forces, reconsider their ambitions, and prepare for the next act. 🕊️The Peace of Nicias in 421 BC is the outstanding example. Athens and Sparta, exhausted after ten years of fighting, concluded a treaty intended to last fifty years. Both sides had suffered grievously; neither had secured a decisive victory; the prospect of relief was understandably attractive. Yet the original disputes remained. Athenian imperial ambitions, Spartan fears of Athenian power, conflicting obligations towards their respective allies, and the political costs of concession had not disappeared. Important provisions of the treaty went unfulfilled, several allies rejected its terms, and hostilities continued through intermediaries and competing alliances. ⚔️In 418 BC came Mantinea, where Sparta defeated an Argive-led coalition supported by Athens. In 416 BC Athens attacked neutral Melos and the following year embarked upon its disastrous Sicilian Expedition. By 413 BC, within a few years, the wider war had resumed in earnest, with Sparta establishing a permanent military position at Decelea in Attica. Thucydides himself, in Book V.26, explicitly rejects the proposition that the intervening years constituted genuine peace. Neither party had fulfilled its obligations, and military conflict had continued. He therefore treats the entire twenty-seven years, from 431 to 404 BC, as one war. 🇷🇺⚔️🇬🇪🇺🇦 By comparison, the present Russian war against free European societies began in Georgia in 2008, continued with the assault on Ukraine in 2014, and intensified with the full-scale invasion of February 2022. Europe has therefore been facing the same contest with the Russian dictatorship for nigh on eighteen years. Neither the smouldering ceasefires that followed the Georgian war nor the various Minsk agreements on Ukraine eradicated the underlying causes or produced a lasting settlement. ⚡️The distinction could hardly be clearer. A treaty may suspend certain operations without settling the conflict that gave rise to them. The appearance of peace does not establish its existence. The war eventually ended with Athens defeated, its fleet destroyed or surrendered, its Long Walls demolished, and its empire dismantled. The settlement of 421 BC had resolved none of the underlying contest over power and security. .... More on this and how Europe can & must address it you can find on our iWi Substack. Link below. @SlawomirDebski @SchullerKonrad @PeterBDoran @John_ForemanCBE @DrChrisParry @ChuckPfarrer
Diplomacy is often a hall of mirrors. Nobody believes the ball will be a success, yet everyone dresses up, puts on a brave face and pretends to enjoy dancing to an orchestra playing out of tune. Form replaces substance because there is no substance. This is one of foreign policy’s greatest traps: we lose sight of the political objective - eliminating war as a means of conducting international relations - and settle for temporarily interrupting it. Before long, we convince ourselves that this was our objective all along. We may even declare victory because the fighting subsides for a few hours. That is how tactical successes lead us towards strategic failure.

Some tentative good news? Despite Trump's recent public rhetoric, it sounds like the White House may have realized neither Washington nor Moscow can force Kyiv to cede more territory and so, at least for now, is focused on trying to convince Putin to accept a ceasefire along current lines of control. ft.com/content/d703aaae-f607… washingtonpost.com/opinions/… nytimes.com/2026/09/17/us/tr…

Spot on @USAmbPoland. This PAC-3 center is a massive win for 🇺🇸🇵🇱 and @NATO, and a great step for 🇺🇸🇵🇱 defense industrial cooperation. Warsaw is the gold standard for American return on investment, and is poised to do much more. In #OIF 2003, only three allies stood with America on day-one combat: Australia, the UK, and Poland. Two now have 🇺🇸ITAR waivers. Granting Poland similar ITAR exemptions will massively expand defense cooperation, strategic joint opportunities, and deterrence. It will secure vital supply chains and supercharge the 250-year-strong #PolishAmericanAlliance. That’s 🇺🇸🇵🇱 First, and underpins America’s global strategy of #PeaceThroughStrength. #ForYourFreedomAndOurs #FYFAO #PolandAmericaAlliance250
OŚWIADCZENIE AMBASADORA USA THOMASA ROSE’A Polska wybrana na lokalizację centrum obsługi technicznej pocisków PAC-3 Decyzja prezydenta Trumpa @POTUS o wyborze Polski na lokalizację centrum obsługi technicznej pocisków PAC-3 to ogromny krok naprzód we współpracy obronnej między Stanami Zjednoczonymi a Polską, który wzmacnia wspólną obronę @NATO. Polska zapracowała na ten sukces dzięki świetnej ofercie, determinacji w rozwijaniu własnego przemysłu obronnego oraz gotowości do inwestowania we własne bezpieczeństwo. Centrum MMF zwiększy kluczowe zdolności w zakresie obsługi technicznej pocisków i wzmocni sprawdzone, niezawodne łańcuchy dostaw. To polska jedność w najlepszym wydaniu! Kiedy polskie instytucje mówią jednym głosem i działają ramię w ramię, Polska wygrywa. Ten sukces należy do całej Polski. To prawdziwy wulkan energii!! Niemcy, Szwecja i Holandia przedstawiły znakomite oferty. Tom Rose Ambasador Stanów Zjednoczonych w Polsce Sorry for any mistranslations!!

Polska to zakład. Polska to punkt ksero. @USAmbPoland, Tom, always thank our Allies first.
STATEMENT BY U.S. AMBASSADOR THOMAS ROSE Poland Selected to Host PAC-3 Missile Maintenance Facility President Trump’s @POTUS decision to select Poland to host the PAC-3 Missile Maintenance Facility marks a major milestone in U.S.–Polish defense cooperation and strengthens @NATO’s collective defense. Poland earned this opportunity through its strong proposal, eagerness to expand its defense industrial capabilities, and willingness to invest in its own defense. The MMF facility will expand critical maintenance capacity and reinforce trusted supply chains. This is Polish unity at its best — the Polish government and the @prezydentpl Presidential Chancellery under @NawrockiKn working together to get the job done. Many thanks to Deputy Prime Minister and Defense Minister Władysław Kosiniak-Kamysz @KosiniakKamysz and the great Polish Rambo @CTomczyk @magdasobkowiak Deputy Minister Magdalena Sobkowiak-Czarnecka, who deserves special recognition. Her tireless advocacy, relentless determination, and personal engagement with senior American officials and defense industry leaders, not to mention her countless midnight phone calls and frenetic text barrages, were instrumental in making this happen for Poland. She’s a firecracker!! Under Secretary of State Tom DiNanno and his team at @StateDept were America’s point of the spear with Tim Cahill @LockheedMartin. Many thanks to Under Secretary of War Michael Duffey @DeptofDefense for pushing this past the finish line. This was no easy decision. Germany, Sweden, and the Netherlands submitted outstanding proposals. All three are indispensable NATO allies whose defense industrial capabilities will be essential as we build NATO 3.0. There will be many more opportunities. This is @POTUS vision in action: allies investing in their own defense, expanding industrial capacity, and working together to build a stronger, more capable, more self-reliant NATO. My @ACGeoEcon colleague @dantannNYC has it right: a General License cannot overturn an explicit legal prohibition in importing Russian oil.
The first tanker of Russian diesel is now on its way to the US after President Trump’s deal with Vladimir Putin. But Oliver Wyman Global Anti-Financial Crime Leader @dantannNYC tells @EenaRuffini and @davidgura, “it is illegal to import Russian diesel… and this OFAC license to buy Russian diesel doesn't overtake that. So there is a question that, technically, customs should be turning away this vessel when it shows up in the US unless they do something to try and bypass it.”
