“It’s a given that the emergence of new communications technologies outpaces the development of statutes and judicial opinions affecting their use and regulation. For instance, it wasn’t until August that the US Court of Appeals for the Second Circuit in New York City finally recognized a First Amendment right to use video recording technologies to film law enforcement officials doing their jobs in public.” @ProfClayCalvert Continue reading here: aei.org/domestic-policy/spee…

Justice Antonin Scalia’s now 15-year-old majority opinion in the violent video game case of Brown v. Entertainment Merchants Association stands as a formidable bulwark against the temptations of today’s lawmakers and litigators to erode First Amendment safeguards for new communications technologies. “Imposing enormous damages awards may incentivize some defendant companies to voluntarily redesign litigation-spawning products and services. If changing some design elements can prevent plaintiff victories without compromising the quality, value, and consumer appeal of the goods in question, then why not implement them? It’s akin to the theory that punitive damages awards will ‘deter similar acts in the future.’” Continue reading @ProfClayCalvert's piece here: aei.org/domestic-policy/tech…

The latest for @AEI from @ProfClayCalvert: While Meta’s massive, voluntary multistate settlement has garnered much media attention, an August ruling in New Mexico against the company illustrates the dangers for speech-centric businesses of states using public nuisance laws not only to fund enormous abatement efforts, but to get judges to force companies to make design changes to their speech-based services. aei.org/domestic-policy/tech…
