It is alarming that almost a hundred years after Dr. Ambedkar burnt the Manusmriti, our courts are citing it while making judicial decisions.
Manusmriti endorses caste-based oppression, untouchability and exclusion, social segregation and subordination of women. The courts are supposed to uphold the Constitution, not the Manusmriti that harks back to the past.

மாவட்டச் செயலாளர்களின் பதவிக்காலம் நிறைவுற்ற 93 தொகுதி மாவட்டங்களில் உட்கட்சித் தேர்தல் நடத்துவது குறித்து உயர்நிலைக்குழு உறுப்பினர்களின் கருத்துகள் கேட்கப்பட்டன. இதைத் தொடர்ந்து கட்சியின் மண்டலச் செயலாளர்கள், மாவட்டச் செயலாளர்களின் கூட்டங்களை நடத்தி அவர்களது கருத்துகளையும் அறிந்து அது தொடர்பாக இறுதி அறிவிப்புச் செய்வதென இந்த உயர்நிலைக்குழு தீர்மானிக்கிறது.
2. சமூகநீதிக் கணக்காய்வு தொடர்பாக அமைச்சரவைக் கூட்டத்தில் எடுக்கப்பட்ட முடிவை வரவேற்கிறோம்!

தமிழ்நாடு முதலமைச்சர் அவர்களின் தலைமையில் இன்று நடைபெற்ற அமைச்சரவைக் கூட்டத்தில் தமிழ்நாட்டில் மக்கள் தொகைக் கணக்கெடுப்பு முடிந்த பின்னர் 2027 பிப்ரவரி மாதத்தில், ஆணையம் ஒன்றை அமைத்து சமூக நீதிக் கணக்காய்வு மற்றும் சமூகநீதி விவரங்களுடன் சாதிவாரி கணக்கெடுப்பு நடத்தவும்; இஸ்லாம் மதத்துக்கு மாறியவர்களுக்கு பிற்படுத்தப்பட்டோர் இடஒதுக்கீடு பெற உரிமையில்லை என்ற உச்சநீதிமன்றத் தீர்ப்பை எதிர்த்து 'சீராய்வு மனு' தாக்கல் செய்யவும் முடிவெடுக்கப்பட்டிருக்கிறது.
அமைச்சரவையின் இந்த முடிவுகளை எமது உயர்நிலைக்குழு வரவேற்கிறது.
அதேவேளையில், இஸ்லாம் மதத்தைத் தழுவியவர்களுக்கு இட ஒதுக்கீடு வழங்குவது தொடர்பாக சீராய்வு மனு தாக்கல் செய்வதோடு; இது தொடர்பாக ஏற்கனவே உள்ள சட்டத்தில் உரிய திருத்தம் கொண்டு வந்து இசுலாமியர்களாக மதம் மாறியோருக்கான இடொதுக்கீட்டைப் பாதுகாத்திட வேண்டுமென தமிழ்நாடு அரசை இந்த உயர்நிலைக்குழு வலியுறுத்திக் கேட்டுக்கொள்கிறது.
“மார்ச் 2024-ல் பிறப்பிக்கப்பட்ட அரசாணையில் உள்ள அடிப்படை குறைபாடு என்னவென்றால், ஒரு மதத்தைச் சேர்ந்த ஒரு நபருக்கு வரலாற்று ரீதியாக இருந்த பின்தங்கிய நிலையை, வேறொரு மதத்தில் உள்ள ஒரு குறிப்பிட்ட 'பின்தங்கிய வகுப்பு' (Backward Class) பிரிவைச் சேர்ந்தவர் என்பதற்குப் போதுமான ஆதாரமாகக் கருதியதே ஆகும்” என்று உச்சநீதிமன்ற நீதிபதி மிஸ்ரா தீர்ப்பில் கூறியுள்ளார்.
ஒரு இந்து, 'பின்தங்கிய வகுப்பு' (Backward Class), 'மிகவும் பின்தங்கிய வகுப்பு' (Most Backward Class), ' சீர் மரபினர்' (De-notified Community) அல்லது 'பட்டியல் சாதி' (Scheduled Caste) ஆகிய பிரிவுகளில் ஏதேனும் ஒன்றில் இருக்கும்போது, அவர் இஸ்லாம் மதத்திற்கு மாறினால், ஏற்கனவே நடைமுறையில் உள்ள ஏழு 'பின்தங்கிய முஸ்லிம்' சமூகங்களில் ஏதோ ஒன்றின் உறுப்பினராக எப்படி மாற முடியும் என்பதற்கான விளக்கத்தை அந்த அரசாணை வழங்கவில்லை” என்று நீதிபதி கூறியுள்ளார்.
அதுமட்டுமின்றி , ஒரு நபரின் 'பட்டியல் சாதி' (Scheduled Caste) அந்தஸ்தை, மாநில அரசின் நிர்வாக ஆணை மூலம் மாற்றவோ அல்லது புதிதாக உருவாக்கவோ முடியாது என்றும் உச்ச நீதிமன்றம் சுட்டிக்காட்டியுள்ளது.
எனவே, 2024 ஆம் ஆண்டு இயற்றப்பட்ட சட்டத்தில் உச்ச நீதிமன்றம் சுட்டிக்காட்டியுள்ள குறைபாடுகளைக் களைந்து, உரிய சட்டத் திருத்தம் செய்யவேண்டுமென்றும்; அதன் அடிப்படையில் புதிய அரசாணையை வெளியிட வேண்டுமென்றும் தமிழ்நாடு அரசை இந்த உயர்நிலைக்குழு கேட்டுக்கொள்கிறது.
3. விலைவாசி உயர்வைக் கட்டுப்படுத்த வேண்டும்!

அமெரிக்காவின் போர் வெறியால் ஏற்பட்டிருக்கும் எண்ணெய் விலை ஏற்றத்தாலும்; இந்திய ஒன்றிய அரசின் கொள்கைகளால் ஏற்பட்டுள்ள பொருளாதார நெருக்கடியாலும் பணவீக்கம் அதிகரித்து நாடு முழுவதும் அத்தியாவசியப் பொருட்களின் விலைவாசி கடுமையாக உயர்ந்துள்ளது. தமிழ்நாட்டிலும் மக்கள் அன்றாடம் பயன்படுத்தும் அத்தியாவசியப் பொருட்களின் விலைகள் அதிகரித்துள்ளன.
செப்டம்பர் 2026-ல், இந்திய அளவில் நுகர்வோர் விலை பணவீக்கம் (CPI) 5.54 சதவீதமாக இருந்த நிலையில், தமிழ்நாட்டில் 6.8 சதவீதமாகப் பதிவாகியுள்ளது. தமிழ்நாட்டில் உணவுப் பணவீக்கம் 10 சதவீதமாக உயர்ந்துள்ளது (தேசிய அளவில் இது 7.3 சதவீதமாக உள்ளது). அரிசி வகைகள், பருப்பு வகைகள் (துவரம் பருப்பு), காய்கறிகள் மற்றும் வெங்காயம் ஆகியவற்றின் சில்லறை விலையில் கடுமையான உயர்வு ஏற்பட்டுள்ளது.
தீபாவளிப் பண்டிகை நெருங்கிவரும் நிலையில் இந்த விலைவாசி உயர்வைக் கட்டுப்படுத்தத் தமிழ்நாடு அரசு அவசர நடவடிக்கைகளை மேற்கொள்ள வேண்டும் என இந்த உயர்நிலைக்குழு கேட்டுக்கொள்கிறது.

When people have come to expect arbitrariness and absurdity from police, law enforcement and the government - they have no way of discerning if someone truly is from government or not even when they make absolutely absurd claims and assertions.
The solution lies in getting people to expect and to believe that the government will always follow due process.
And that will come from government getting into habit of behaving well and following the due process.
And that will come from courts beginning to take due process violations with utmost seriousness and taking to task errant officers.
And that will come from courts becoming structurally and functionally independent and not fearful of taking government officials to task.
And that will come from an executive that is responsible and elected with an actual popular mandate through free and fair elections and not a bully that has installed itself by hook or crook.
And that will come from an independent election commission which can ensure free and fair elections.
