I don’t really know what the answer here is but I would think any law that says “X is intoxicated and cannot consent” would have to go both ways. If 2 drunk people fuck and decide the next day they didn’t consent did they rape each other? Do they both go to jail?
Choosing to have a drink is not consent, and it’s never a license for sexual assault.
New York law should reflect that.
I support closing the voluntary intoxication loophole and will work with the Legislature to get it done.

When I was in college this would've been considered really *really* gay, and it's unfortunate the woman is taking the brunt of it. But that doesn't mean she was raped. She let herself be treated like a piece of shit, then is shocked the guys who participated are pieces of shit.
The texts between her and her male friend/alleged rapist are so sad. She trusted him and he betrayed her. I am just so sad for this girl.

In addition to the below, I'd suspect almost no one knows precisely how their state legally handles consent.
You can see in the comments that many people assumed that her being drunk and/or high meant she could not consent. But that's not the actual standard in NY.
With this in mind, it doesn't seem unreasonable that she
1. Woke up the next day and felt gross about the whole ordeal
2. Upon further reflection, she might have believed it to be rape based on her being drunk and/or high and gave a description of events that she didn't even realize was exculpatory
Did we not learn from the Trump/Carol lawsuit that what the law says is rape in NY is not the same as what people colloquially call rape? What went down is gross and yea 6 dudes running train on one girl, whether consensual or not, is gross for all involved.
I don’t know much about the story. I remember in college 20 years ago posters saying things like if you’re both drunk he took advantage of/raped you. But being wasted and making bad decisions isn’t a felony. They should explain that to the students.
Here's one thing I'm confused about re: the Cornell rape case: The DA says that the reason his office didn't bring charges is that Jane Doe told police that what happened was "voluntary, conscious, and consensual." But like... who is going to the police station to report voluntary, conscious, and consensual group sex? Obviously that's not what she thought it was.

people had dial-up. they checked email after work, looked at a couple sites, hung up so the phone was free. why pay more for something that just made the same two things slightly less annoying.
took years before anyone realized always-on speed unlocked streaming, shopping, maps, homework, remote work, all the stuff that just became normal later.
first users looked like weirdos running napster and ftp. actual normie use cases showed up after the pipe got cheap and boring.
agents are in that same lag. the flashy demos are just early power users doing extra. the real stuff is still forming: deal with insurance, fix the kid’s homework, plan the trip without 11 tabs, write the awkward email.
doesn’t look impressive in a screenshot. just quietly eats the parts of the evening that currently suck.
