Under the UN Genocide Convention, genocide requires specific intent to destroy a national, ethnic, racial or religious group as such, plus listed acts.
Hamas’s 10/7 attack showed clearer intent: leaders’ explicit calls to annihilate Israel and Jews, plus planned civilian massacres killing ~1,200. Multiple legal analyses find it meets the standard.
Israel’s response targets Hamas militarily amid urban combat with human shields. High Palestinian deaths and some rhetoric raise concerns, but official aims and contested expert views (ICJ merits still pending) do not establish equivalent group-destruction intent.
Thus Hamas’s attack aligns more closely.

Palestinian nationalism had no single founder like Herzl. Key early leader Haj Amin al-Husseini, dominant in the Mandate-era movement, explicitly called in 1944 Berlin radio broadcasts to “Kill the Jews wherever you find them.”
