Thanks to KC for the nice profile.
It was fun to reminisce about my time as a college athlete with @WMTribeMBB.
And to discuss my legal work in the college athletics space and what the future of college athletics might look like.
"... a model like that would bring stability to college athletics."

Relevant to lots of things in college athletics.👇
“[I]n my review of more than 80 comments submitted through the proposal website, I did not see a single comment indicating that the institution had consulted its own players. Before deciding their future, shouldn't we ask them?”
The Ohio Supreme Court makes it clear that the class of 2022 athletes who are plaintiffs in the Ohio 5 in 5 case are currently eligible.
The NCAA previously stated it was taking the position they are not eligible and threatened schools who played them.
We may now get a decision in this case on whether liquidated damages provisions in college athlete rev-share agreements (colloquially referred to as buyouts) are enforceable, or whether they are unlawful penalties.
Would be a very important decision for college athletics.
An interesting aspect of the push for the Protect College Sports Act is that it’s being used in an attempt to get a do-over on the House settlement without needing class counsel/plaintiffs’ approval.
Some aren’t happy with the results of the settlement agreement.
Latest for @FOS
Hours before endorsing the Protect College Sports Act the SEC received a memo from a GOP staffer that ended with
“After the election, because of who is likely to win the House, you won’t see this bill…being considered The asks from the Democrats begin with employee status, collective bargaining rights, and end with private right of action. Let’s get this done.”

An Idaho federal court granted a preliminary injunction in a 5 in 5 case in favor of four Boise State track and field athletes.
The court found the NCAA is likely in breach of the express terms of the new eligibility rule, meaning it doesn’t exclude the class of 2022.
Texas judge denies temporary injunction for athlete plaintiffs that were previously part of the Georgia 5 in 5 case.
Update on the Texas 5 in 5 case that the former Georgia 5 in 5 case plaintiffs joined.

Good look at the Big Ten’s new rule capping school facilitated associated entity NIL deals.
The big question: will the rule stand if the PCSA doesn’t pass and House class counsel challenges the rule?
From the Obama library and Big Ten headquarters, a deep dive into the latest fascinating change in the industry: the Big Ten’s cap rule that House attorneys say is illegal.
Will the league fight with Jeffrey Kessler?

Here's the full language of the Big Ten's new rule that caps the value of associated entity NIL deals that can be facilitated by member schools ($27.5M/yr).
Schools exceeding the cap will have to pay financial penalties based on a % of the amount by which they exceed the cap.
The FL AG has filed his brief in support of Denzell Aberdeen in the NCAA’s appeal of the injunction granted in Aberdeen’s favor.
The AG takes the position (as a number of courts have found) that the language of the NCAA’s new eligibility rule doesn’t exclude the class of 2022.
Makes sense.
Would make more games relevant and increase fan interest.
NEW: Nearly two-thirds of Group of 6 coaches want their own playoff – w/1 condition. @On3 surveyed all 70 coaches 👀
A G6 coach: “Anyone who says a G6 team can win a national title in today's NIL environment is delusional”
The results will surprise you. on3.com/news/on3-survey-most…
College football has never put a more compelling and competitive product on the field.👇
And this is because the athletes are now allowed to freely participate in the labor market for their playing services.
Disruption and change do not equal broken.
The plaintiffs that withdrew from the Georgia 5 in 5 case are now seeking to join a 5 in 5 case pending in Texas state court.
There’s a hearing on their request for a preliminary injunction tomorrow.
Many of the plaintiffs in the Georgia 5 in 5 case have dismissed their claims against the NCAA in that case.
Expect them to soon file new cases in different states.
Here’s the order denying the NCAA’s motion to stay Denzel Aberdeen’s preliminary injunction.
Notably, the FL attorney general’s motion to file an amicus brief in support of Aberdeen has been granted.
Like Ohio, it appears FL supports class of 2022 athletes playing this season.
LSU is now prohibited from adhering to the SEC rule prohibiting pros from returning to member school teams.
And the SEC is prohibited from punishing LSU for not following the rule.
Meaning Luis is currently eligible to play.
RJ Luis is temporarily eligible to suit up for Will Wade and LSU basketball without any repercussions from the SEC.
Spoke to Luis' attorney about how this happened, their legal plans, etc.
"LSU may be intimidated by ‘Kim Jong’ Sankey, but we're not."

An appellate court has again denied the NCAA’s request to stay a preliminary injunction granted in a class of 2022 5 in 5 case.
Roddy Gayle’s TRO has been converted to a preliminary injunction.
He remains eligible to play.
