THE REGULATOR FIRED THE MAN WHO TOLD THEM PATIENTS WERE BEING HARMED. Shyam Kumar is a consultant orthopaedic surgeon. From 2015 he worked part-time for the Care Quality Commission @CareQualityComm as a specialist adviser on hospital inspections. He used that position to do exactly what it existed for. He raised concerns about unsafe inspection practices. He flagged a surgeon at Morecambe Bay NHS Trust whose operations were harming patients. He warned that trust management was trying to bury it. He told the CQC that patient safety was being "significantly compromised." He did his job. The CQC's response was to treat his disclosures as a nuisance and a threat rather than recognise their seriousness. The decision to sack him in December 2018 was explicitly linked to his disclosures. A senior CQC official maintained that Kumar had been dismissed for inappropriate behaviour, a position later comprehensively rejected by the Employment Tribunal. The CQC barrister called his claims "fanciful." The Manchester Employment Tribunal found him unfairly dismissed. The surgeon he flagged at Morecambe Bay eventually had conditions placed on his licence to practise. So not fanciful at all. Just inconvenient. This is the same regulator that had previously victimised CQC staff who spoke out about poor inspection methodology a decade earlier, at the time of the Mid Staffordshire Public Inquiry. They learned nothing. They just got better at paperwork. After winning, Kumar demanded to know what action the CQC had taken against the officials responsible for wrongly dismissing him and attempting to destroy his reputation. The answer, as far as the public record shows, is: not much. Ted Baker, the CQC's former Chief Inspector of Hospitals who maintained the CQC line against Kumar, was subsequently appointed Chair of the Healthcare Safety Investigation Branch. A body that, presumably, requires sound judgement. The body that exists to protect patients fired the man protecting patients. Everyone else got promoted. 120 DOCTORS ARE FIGHTING THEIR OWN NHS TRUSTS. NOBODY IS TALKING ABOUT IT. Dr Amit Mukherjee raised patient safety concerns at his NHS Trust. That's not just his right. It's his legal duty. The NHS calls it a duty of candour. Apparently Trusts call it a provocation. What followed would be funny if it wasn't happening to a real person. The Trust launched a full employment tribunal against him. It hired expensive QCs to cross-examine him. It racked up around £90,000 in legal costs and then threatened to personally recover every penny from him if he lost. From a doctor. Who was trying to protect patients. He now avoids all interaction with colleagues. He hides. He takes only temporary roles. He is a consultant psychiatrist in one of the most understaffed specialties in the NHS and he is living like a man who accidentally witnessed a mob hit. And he is not alone. Around 120 clinicians are simultaneously fighting employment tribunals for whistleblowing right now. One hundred and twenty. The NHS set up Freedom to Speak Up Guardians specifically to protect people like Dr Mukherjee. He says they worked with senior management against him. The system designed to protect him became another instrument of the same pressure. That detail should be in every newspaper in the country. It is not. Nobody was sacked for retaliating against him. Nobody faced any professional consequences. The Trust just spent public money trying to financially ruin a doctor whose only offence was telling the truth about patient safety. This is not a broken system. A broken system produces accidents. This is a working system. It works exactly as intended. Speak up and we will make your life so miserable that every other doctor watching will know to stay quiet. Dr Mukherjee is still fighting. So are the other 119. If you know someone who works in the NHS, share this. They probably already know a version of this story. They just couldn't say it out loud. I hope as many resident doctors as possible see this. You are being thoroughly shafted on pay, working conditions, and employment opportunities. @wesstreeting is the man responsible, and this is how he “values” you: with playground insults. Strike hard, and keep striking.
Wes Streeting says doctors’ unions are “moaning Minnies” and accuses the BMA of “juvenile delinquency” on Sky News today. Source: Sky News #UKPolitics #NHS #BMA #WesStreeting #SkyNews

Just 15 months after qualifying as a doctor with ++ competitive med school entry… these are the ridiculous ADDITIONAL requirements you need just to qualify for an interview for specialist training… If they don’t meet the criteria- it’s career over & unemployment.
Another day, another example of how broken training is in the NHS I challenge any consultants here to have scored the cut off of 22 JUST TO MAKE INTERVIEW for medical training after FY2 This situation is because of active choices We need a hard policy and people reset!

I dont know about anyone else but F1/2 for me was survival mode. You have the most rubbish of the rotas, the lowest of the pay. How anyone if functioning outside of 47 hour weeks to even get close to cut off is ridiculous
Internal medicine (IMT) now requires 22/30 points on the portfolio score to guarantee an interview (if applying to other specialties). How is an F2 doctor supposed to have a portfolio of this standard? Essentially locked out of direct career progression in a medical specialty.

100% agree. How does having publications prove you are a competent and compassionate doctor? Honestly, some of the worst doctors I’ve worked with probably look the best on paper 🫠 idk what the answer is but it’s not this.
You should not have to do research to enter IMT (or basically any training programme)

I’m an IMT1 working in London. If I’d applied this year, I wouldn’t even have got an interview. This broken system is not fit for purpose, and is failing excellent doctors who just want to progress in their careers. The Government can’t sit on their hands any longer.
Patients need doctors, and doctors need jobs. Yet, it’s harder than ever for residents to get into Internal Medicine Training (IMT). The Government needs to fix the specialty training crisis NOW. bma.org.uk/our-campaigns/res…

The recruitment system in England is a utter disgrace. We now have fully trained NHS doctors who cannot find work. Every medical leader who stood by and let this happen should be ashamed. This is a total failure of workforce planning. Doctors deserve better than this.
This week, thousands of resident doctors have been turned away from NHS jobs – as we warned the Government they would be. We are calling on NHS England to urgently address this situation. The specialty recruitment process is not fit for purpose & must be fixed once and for all.

Given the very high score for IMT I am appealing to fellow managers - advertise your JCF posts internally first. Good chance you can fill from your own current F2s. If every trust does this we can mitigate unemployment in doctors we are currently training. @ResidentDoctors

Don’t just tell half the story, Mr Streeting. You have also allowed a situation where qualified doctors are effectively being replaced by cheaper ACPs who cannot provide the same level of care. You have offended residents by making sure their pay as fully trained doctors is lower than that of people “playing doctor” some of whom are unregistered and unaccountable. You have created a doctor bottleneck with fierce competition for training posts, leaving many doctors unemployed - while at the same time some nurses are being pulled from already short-staffed nursing rotas to cover doctor roles, which only worsens the staffing crisis on both sides. If you want to explain the reasons behind these decisions, the public deserves to hear them too. If the goal is to reduce the number of doctors in the NHS and shift to a workforce mainly made up of ACPs, then be honest about it. That would inevitably create a two-tier healthcare system. But the knowledge will at least give the opportunity for the public to start saving for private healthcare fees or accepting they will not get good care if they are poor. And young British people can make informed decisions about whether to study medicine in the UK and, if they choose to, to be clear they need to plan to emigrate early - unless they have the rainbow unicorn level of luck currently needed to secure a specialist training post. I am not sure how many future doctors will want to become consultants in ten years’ time if we end up with no residents, no staff grades, no associate specialists, and a system full of unregulated non-doctors taking on doctor roles while consultants bear the legal responsibility. I certainly won’t be part of that - and good luck to those who choose to be. The lawyers won’t go easy on you - I promise you that. @drphilhammond @Channel4News @MichelleWelshMP @PeterElston1 @Michelehal7344 @Voice4theDead @Dr_Done_ @ExplosiveEnema2 @parthaskar @TheBMA @bmj_latest @DavidDavisMP
The BMA have to take responsibility for the pain they are causing patients. I’ve given them a 28.9% pay rise, and offered more jobs, career progression, and help with expenses. Have the courage to put the offer to your members, @BMAResidents.

Wes Streeting has the audacity to call resident doctors greedy, for asking for pay restoration from £18 to £22/hr FYI -he pays their assistants £24/hr- drs are asking for LESS He’s had no problem accepting £372,000 himself from private health care links He’s destroying the NHS
'Don't tell me you don't want to be out on strike - because that is exactly where you are. Own it.' As resident doctors walk out again, @wesstreeting calls out the 'reprehensible and cartel-like behaviour' of their union.
