๐ฐ Issue 6 of #TheEastAfricanPrivacyMonthly is here!
A little late than usual, this edition opens with our cover story on the 5th Edition of the Unwanted Witness Uganda Privacy Moot Court Competition. Our Partnerships & Development Co-Head, Maria Nanyonga, sat down with @allan_sempala, Head of Legal and Programs at @UnwantedWitness. They discussed how the moot grew from six Ugandan universities in 2022 to 48 universities across Uganda, Kenya, Tanzania and Rwanda this year, and why fintech, loan apps and law schools sit at the heart of East Africaโs #dataprotection journey. Congratulations to Uganda Christian University, the first university to defend both its national and regional titles! ๐
September also brought key regulatory developments across the region and beyond:
๐บ๐ฌ Uganda: Following concerns raised by activist Lutaaya Godfrey, Tecnolegal Advisory Centre Ug and DPO Privacy Centre (East Africa), the Personal Data Protection Office, Uganda (PDPO) engaged Uber on its data protection obligations after the company exited the Ugandan market. The PDPO also delivered two decisions:
1๏ธโฃ Lilian Namagembe v Teach For Uganda & Another on the right to deletion.
2๏ธโฃ Joseline Twemanye v St. Francis Hospital Nsambya on the disclosure and rectification of birth records.
๐ฐ๐ชKenya: The Office of the Data Protection Commissioner (ODPC) published a draft Public Notice proposing to add political affiliation and trade union membership to the categories of sensitive personal data. It also issued new Guidance Notes for Cross-Border Data Transfers, including Kenyan standard contractual clauses.
๐ Across Africa:
โ๏ธ POTRAZ began mandatory on-site compliance inspections in Zimbabwe.
โ๏ธ The revised ECOWAS Supplementary Act on Personal Data Protection awaits publication.
โ๏ธ Togoโs IPDCP rallied 33 ministries in a public sector compliance drive.
โ๏ธ Data protection authorities marked the inaugural Africa Data Protection Day.
๐ Globally:
โ๏ธ Key obligations under the EU Data Act and Cyber Resilience Act took effect.
โ๏ธ Irelandโs Data Protection Commission fined Google โฌ403 million over location data.
โ๏ธ The UKโs Information Commissioner's Office (ICO) became the Information Commission.
โ๏ธ Chinaโs simplified rules for small-scale processors came into force.
โ๏ธ Californiaโs data broker deletion platform (DROP) entered its first enforcement cycles.
